Charlotte Gaitanides

Charlotte Gaitanides (* 1965 in Munich ) is a German lawyer and former high school teacher.

Life

Gaitanides studied law at the Johann Wolfgang Goethe University in Frankfurt am Main . After the first state examination in law in Frankfurt in 1989, she studied from 1989 to 1990 as part of an Erasmus scholarship from the University of Heidelberg, the master's degree in “European Law” at the Autonomous University of Barcelona .

In 1993 she did her doctorate in Frankfurt with the thesis The integration of the former GDR into the European Community under the aspect of state aid (first reviewer: Manfred Zuleeg ). Gaitanides completed his legal clerkship in 1995 with the second state examination in law. In 1996 she worked as a legal advisor at the General Directorate “Competition” of the EU Commission in Brussels. From 1997 to 2003 she was a research assistant at the Helmut Schmidt University in Hamburg . 2004 habilitation them at the Goethe University in Frankfurt with the published 2005 work The right of the European Central Bank. Independence and cooperation in the European Monetary Union (first referee Manfred Zuleeg, second supervisor: Joachim Wieland ). She received the license to teach public law , including European and international law . From 2004 to 2007 Gaitanides worked as a lecturer at the Helmut Schmidt University in Hamburg. In 2007/2008 she represented the chair for public law, media and telecommunications law at the University of Karlsruhe .

In 2009 Gaitanides took over the management of the English-language course "European Studies" at the University of Flensburg . Temporary Vice President of this institution, she resigned from this position in February 2015 and finally turned her back on her academic career after the plagiarism research platform VroniPlag Wiki had alleged both her dissertation and her habilitation thesis. Habilitation and private lecturer rights were revoked by the home university.

Gaitandes sued the Frankfurt Administrative Court against the withdrawal of her habilitation from the Goethe University Frankfurt. After she had renounced the designation private lecturer and the rights from the teaching qualification, the university would no longer have a basis for withdrawal. The court dismissed the lawsuit in March 2019.

In connection with the plagiarism affair, the Federal Constitutional Court also cited Gaitanides' habilitation thesis "interspersed with plagiarism" in its much-noticed ruling of July 30, 2019 on the European Banking Union , namely a passage that Gaitanides found in the dissertation of the VroniPlag Wiki Berlin lawyer Jan Endler had borrowed. Endler himself is not mentioned in the decision of the Federal Constitutional Court.

Gaitanides conducted several press law proceedings to report on her plagiarism cases. At the end of 2019, the Frankfurt Higher Regional Court decided that a name may be mentioned in reports on the case and justified this with the fact that the author had made herself public through her writings, so that a right to be forgotten did not apply. The naming is also necessary to prevent a "perpetuation of these plagiarisms", which "goes against scientific interests". Just naming the title of the rejected works without naming the author is not enough.
