Cornel Borbély

Cornel Borbély (* 1978 , resident in Dürnten ) is a Swiss lawyer . He is a lawyer in Zurich and was Chairman of the Investigative Chamber of the FIFA Ethics Committee from December 2014 to May 2017 .

Life and education

After graduation , he worked from 1997 to 2000 for a major bank and studied at the same time at the University of Zurich Law . Borbély graduated in 2003 and received his doctorate in 2005, also at the University of Zurich. He received a degree in forensics from the Lucerne University of Applied Sciences in 2007 and a master's degree in Economic Crime Investigation in 2012.

Professional career

Borbély was in 2006 in the canton of Zurich as a lawyer licensed and registered in the same year Secretary to the prosecutor of the canton. In 2007 he was appointed public prosecutor with responsibility for general criminal matters. Borbély moved to the white-collar crime department in 2008 and was group leader there from 2011. After leaving in 2014, Borbély worked as a lawyer at a law firm in Zurich. In 2015 he opened his own law firm specializing in criminal and commercial law in Zurich.

At the end of 2016, the business magazine Bilanz voted Borbély one of the 10 most important business lawyers in Switzerland.

FIFA

Borbély became vice-chairman of the Investigative Chamber of the FIFA Ethics Committee in May 2013. Together with Michael J. Garcia , the chairman of the investigative chamber, he investigated the corruption allegations in connection with the awarding of the 2018 and 2022 World Cups to Russia and Qatar . In order to avoid conflicts of interest for the American Garcia, Borbély was given primary responsibility for investigations into the 2018 World Cup in October 2013. The investigation report was submitted to the Judicial Chamber of the FIFA Ethics Committee in September 2014. After Garcia resigned as Chairman of the Investigative Chamber, FIFA appointed Borbély as his successor. The FIFA Congress in May 2015 confirmed him as chairman. Together with Hans-Joachim Eckert , the chairman of the Judicial Chamber, Borbély campaigned decisively against a confidentiality clause in ongoing proceedings by the FIFA Ethics Committee and for more transparency and the right to information. In October 2015, the FIFA Executive Committee approved new rules for the disclosure of investigative information.

Borbély was responsible for investigating high-ranking FIFA officials such as Jérôme Valcke , Jeffrey Webb , Franz Beckenbauer , Eugenio Figueredo , Nicolás Leoz , Ángel María Villar Llona , Jack Warner , Chung Mong-joon , Wolfgang Niersbach and Theo Zwanziger . Borbély was not responsible for the investigation into the former FIFA President Sepp Blatter , as Blatter is also Swiss. Borbély was represented by Robert Torres from Guam . Because the investigation against Blatter also involved UEFA President Michel Platini, responsibility for the investigation against Platini was transferred to Vanessa Allard from Trinidad and Tobago .

In May 2017, he had already been invited to the relevant FIFA Congress in Bahrain and had traveled to Bahrain , without giving any reasons and contrary to previous statements by Secretary General Fatma Samoura during the approach that he would not be nominated for re-election. Borbély interpreted this as the silting up of hundreds of other cases that were on his desk and commented: "The code of ethics [of FIFA] is a dead piece of paper." His successor was the Colombian María Claudia Rojas .

Sports Governance Unit

Together with Hans-Joachim Eckert , the former chairman of the Judicial Chamber of the FIFA Ethics Committee, and Marc Tenbücken, a communication expert, Borbély founded the Sports Governance Unit in November 2017, which advises sports associations, clubs and sponsors on good governance .

Borbély is head of investigative magistrates in the Swiss military justice system and holds the rank of lieutenant colonel . He is a lecturer in white collar crime and director of a master’s course in economic crime investigations. In March 2018 he was elected to the supervisory authority of the Federal Prosecutor's Office by the Swiss Federal Parliament. He resigned on November 19, 2018 to free up resources for the agency after FIFA issues had become central to the agency's work. With these, Borbély would have been on permanent strike due to his previous work for the FIFA Ethics Committee.
