Hans-Joachim Eckert

Hans-Joachim Eckert (* 1948 in Plochingen ) is a German lawyer . He was from October 2005 to July 2015 President Judge of a grand economic criminal division at the Munich I Regional Court . From July 2012 to May 2017 Eckert was chairman of the adjudicatory chamber of the FIFA Ethics Committee .

Origin and education

Hans-Joachim Eckert was born in Plochingen , Baden-Württemberg . Shortly after his birth, his family moved to Upper Bavaria . Eckert graduated from high school in Freising and then studied law in Munich .

Professional career

From 1978 to 1985 Hans-Joachim Eckert was a judge at the Munich I Regional Court, criminal court and then a public prosecutor at the Munich II Public Prosecutor's Office. From 1985 to 1991 he worked as a judge at the Munich I Regional Court, civil court and from 1991 to 1998 he was a public prosecutor at the public prosecutor's office Munich II, as head of department responsible for criminal tax matters , economic criminal matters and organized crime . From 1998 to 1999 he was chief prosecutor at the Prosecutor General in Munich, responsible for the supervision of different public prosecutors, money laundering , organized crime and international relations. From 1999 to 2003 he was then Chief Public Prosecutor at the Munich I Public Prosecutor's Office, head of the department for general and economic criminal matters and responsible for data protection , Nazi violent crimes , economic criminal matters and organized crime. In September 2003 Eckert became the presiding judge at the Munich Regional Court I and until September 2005 he focused on drug-related crime .

From October 2005 until his retirement in July 2015 he was the presiding judge of a large commercial criminal chamber at the District Court of Munich I ( corruption , tax fraud, commercial criminal matters).

His previous activities focused on corruption proceedings, tax evasion , general economic crime, organized crime, money laundering, internet and computer crime , as well as asset recovery .

Eckert has also worked internationally for the EU Commission , for example in Bulgaria , Serbia and Turkey . In Bulgaria he advised the government on behalf of the European Union and helped set up a public prosecutor's office specializing in corruption cases . In addition, Eckert investigated 300 unresolved murders there with an Italian Mafia investigator.

Eckert is a consultant for organized crime, cybercrime and profit skimming at the German Judicial Academy , the European Law Academy and at the advanced training institutes of the Bavarian Police .

Procedure

As presiding judge at the Munich Regional Court I, Eckert has led a number of well-known cases in the field of white-collar crime, including the corruption processes in connection with bribes at Siemens , Ferrostaal and MAN . He also led the legal proceedings to process the purchase of Hypo Group Alpe Adria by Bayerische Landesbank .

FIFA Ethics Committee

Hans-Joachim Eckert was elected to the FIFA Ethics Committee in 2011. Eckert has been investigating corruption allegations in FIFA since 2012 . the World Cup award. On July 17, 2012, he was appointed by the FIFA Executive Committee to chair the adjudicatory chamber of the FIFA Ethics Committee. The appointment was confirmed by a FIFA Congress in May 2013. At the end of 2014 Eckert's work was heavily criticized by the chief investigator of the FIFA Ethics Committee, Michael Garcia . Garcia resigned at the same time. In October 2015, the adjudicatory chamber of the FIFA Ethics Committee, chaired by Eckert, imposed a temporary ban of 90 days on FIFA President Sepp Blatter , FIFA General Secretary Jérôme Valcke and UEFA President Michel Platini . On November 23, 2015, Eckert opened the official proceedings against Blatter and Platini. After the proceedings were over, Eckert announced the verdict on December 21, 2015, imposing a ban of eight years and fines on both of them. He opened the proceedings against Jérôme Valcke at the beginning of January 2016. On February 12, 2016, the verdict was pronounced and Valcke was given a 12-year ban and a fine.

After Eckert had been invited to the FIFA Congress in Bahrain , at which his re-election was due, and had arrived on May 9, 2017, contrary to positive assurances from General Secretary Fatma Samoura , he received notification in the weeks after his flight had landed that he would be from FIFA Council was unanimously not re-nominated. In the past, FIFA President Gianni Infantino described himself as a “hostage of the supervisory bodies” and, according to various reports, had Eckert and his colleague Cornel Borbély released from the investigative chamber. Eckert stated: “I regret this development. It means the end of the reform process at Fifa. ”In an interview with Deutschlandfunk , he said that some explosive functionaries would have been investigated in the next few months and that critical people would obviously prefer to be exchanged for others. Sports Governance Unit

Together with Cornel Borbély , the former chairman of the investigative chamber of the FIFA Ethics Committee, and Marc Tenbücken, a communication expert, Eckert founded the Sports Governance Unit in November 2017 , which advises sports associations, clubs and sponsors on good governance .

Personal

Eckert is a passionate mushroom picker . In his free time, he also visits a secondary school in the Bavarian Oberland to explain the justice system to students and answer their questions.
