Egon Schneider (lawyer)

Egon Schneider (born April 3, 1927 in Cologne ; † October 3, 2014 ) was a German judge .

Life

Schneider studied law at the University of Cologne and passed the first state examination in law in 1954 . In the same year he was awarded the dissertation Qualified by indebted consequence offenses Dr. jur. PhD. In August 1958, after completing his legal traineeship and the assessor exam, he joined the judicial service of the state of North Rhine-Westphalia . On May 1, 1962, Schneider was appointed regional judge at the Cologne Regional Court. There he was primarily in civil chambers working and devoted himself to even the training of legal trainees. The following incident was discussed from his training activities: Schneider gave the case of Des Esels Schatten to his trainee lawyers to work on and wrote an article about it in the legal newspaper (JZ). The question was whether the lease on a donkey gives the tenant the right to use the donkey's shadow in the midday heat. Schneider criticized the trainee lawyers because they worked on the case legally, although the dispute was not a “proper subject of (legal) scientific discussion”. Other judges contradicted this in the JZ.

In 1968 he moved to the Cologne Higher Regional Court , where he was appointed Higher Regional Court Councilor on March 1, 1969 . At the OLG he was a member of the 2nd civil senate from autumn 1968 until his retirement , which deals with enforcement and bankruptcy law as well as some areas of voluntary jurisdiction . Most recently he was deputy chairman of the Senate. After his retirement, which took place on May 1, 1989, Schneider still worked as a lawyer . Now independent, Schneider developed into a critic of his profession , which at times earned him the reputation of a dirty nest .

The lawyer at the Federal Court of Justice Ekkehart Reinelt wrote in his obituary : “Despite excellent grades and assessments, he deliberately refrained from chairing a senate at the Higher Regional Court. He feared that the prominent position could complicate his sustained criticism of the judiciary (for example in the 'Justice Mirror'). "

Schneider was at times celebrated as the grand master of civil procedural law . Especially in the areas of legal education and civil procedure law, he established standard titles.
