Georg Müller (born September 30, 1942 in Schönenwerd ) is a Swiss jurist and professor emeritus for constitutional law , administrative law and legislative theory .

Education and career

Müller attended primary and district school in the town where Bally was born . In 1962 he graduated from the canton school (literary school) in Aarau with the Matura . He studied from 1962 to 1966 at the Law Faculty of the University of Basel , where he obtained his licentiate (lic.iur.). He then wrote a dissertation on the subject of the government staff office as a constitutional problem . He received his doctorate in 1969 with the grade summa cum laude; The speaker was Kurt Eichenberger . He completed his internships in a law firm in Aarau and as a clerk at the Aarau District Court. In 1971 he acquired the Aargau patent for advocates (authorization to practice the legal profession). He wrote a habilitation thesis entitled Content and Forms of Legislation as a Problem of the Democratic Order of Competence . In 1978 he completed his habilitation at the Law Faculty of the University of Basel.

Professional career

From 1967 to 1969 Georg Müller worked part-time as adjunct to Hans Dubs , the legal consultant of the Aargau government council. The successor to Hans Dubs, who was elected federal judge, was Wilfried Schaumann , with whom Müller worked as a full-time adjunct from 1970 to 1972. From 1972 to 1979 Müller was himself head of the legal service of the Aargau government. In 1979 he was elected full professor for constitutional and administrative law at the Law Faculty of the University of Zurich . In 1982 he was appointed full professor of constitutional and administrative law as well as legislative teaching at this faculty. 1994–1996 he was dean of the faculty. Before that, he was President of the Board of Trustees of the Foundation for Legal Education in Zurich for several years . In 1999 he founded the Center for Legislative Studies at the Law Institute of the University of Zurich , which he headed until 2006. He retired on August 31, 2006 . Felix Uhlmann took over his chair.

Act

Müller's connection of practical relevance with scientific thoroughness is emphasized in his successful and widely recognized work. His didactic talent is also outstanding, as his textbook on general administrative law and the one on legal theory express. He was a pioneering teacher and researcher in the field of legislation. The published results of his research work on the legislative delegation, the delimitation of legislative powers of the legislature and the government, the guarantee of property, the principle of equal treatment and the arbitrariness of the state are numerous and much noticed.

Since 1979 he has authored numerous legal opinions for the federal government, cantons and municipalities. At all of these three levels he was a member of many expert commissions - often as their president - and co-creator of enactments. In doing so, he gained general recognition. Although cautious in bringing his own person forward, he did not shy away from going public when it came to defending or enforcing postulates that had been recognized as correct in careful research. He put forward his scientifically founded concerns in votes, articles in specialist journals, articles in commemorative publications and in the daily press. If he considered it necessary for objective reasons , he did not spare the Liberal Democratic Party , of which he is a member. He stood out not only as an advisor to Swiss authorities, his warning voice also had weight on international forums because of his incorruptible, scientific foundation. 1983–2001 he was a member of the editorial team of the Swiss Central Gazette for Constitutional and Administrative Law (until December 1988: Swiss Central Gazette for State and Municipal Administration ). From 1994 he headed the editorial department of this journal. Before moving to the University of Zurich, he presided over the Aargau Legal Association for several years. Georg Müller did well over 1000 days of military service . Among other things, he commanded a division of the tank artillery and ended his military career with the rank of colonel.

Private

Georg Müller has been married to Therese Bossert since 1969. The marriage resulted in a son and a daughter.

Honors and appreciation

On October 29, 2008, he was awarded an honorary doctorate in law by the Faculty of Law at the University of Lucerne and on November 12, 2010, the Grosse Walther Hug Prize.
