Hans-Justus Rinck

Hans-Justus Rinck (born September 5, 1918 in Hameln ; † August 13, 1995 in Karlsruhe ) was a German lawyer , judge at the Federal Court of Justice and judge at the Federal Constitutional Court .

Life

Rinck was the son of the student councilor Friedrich Rinck and his wife Margarete, née Bähr. He was called up for military service in 1937 and served as a soldier in World War II . After the war ended, he studied law and political science at the University of Göttingen from 1945 to 1949 . In 1950 he married Gisela Fischer, with whom he later had a son and three daughters. In 1952 he received his doctorate in law with a thesis on "Natural Law at Blackstone ".

After the second state examination in 1954, he was first accepted as a court assessor in the Lower Saxony judicial service. In November 1956 he was seconded to the Federal Constitutional Court. Here he worked mainly with Gerhard Leibholz and soon became one of his close confidants. His secondment lasted almost ten years and was only interrupted by a brief activity as assistant judge at the Higher Regional Court in Celle from September 1963 to February 1964. During this time he was also promoted to the District Court Councilor (1959), the District Court Councilor (1960) and the Higher Regional Court Councilor (1964).

In August 1966 he was appointed judge at the Federal Court of Justice. He stayed there for only two years, as he was elected judge of the Federal Constitutional Court by the Bundestag in 1968 at the proposal of the Union . He succeeded Anton Henneka in the second Senate. He did not endorse the decision of the Federal Constitutional Court issued in 1983, in which the dissolution of the German Bundestag by Federal President Karl Carstens was declared constitutional due to the loss of confidence placed by Helmut Kohl . He justified his negative view in a separate vote .

In 1986 he retired for reasons of age. On this occasion he was honored with the Great Cross of Merit with Star and Shoulder Ribbon of the Federal Republic of Germany.

Together with Gerhard Leibholz, Rinck founded a commentary on the Basic Law that first appeared in 1968. After Leibholz's death in 1982 he continued this together with Dieter Hesselberger . Until 1994 he devoted himself to updating the commentary, which has now been designed as a loose-leaf collection.
