Herbert Mayer (lawyer)

Herbert Mayer (born April 8, 1951 in Schwäbisch Gmünd ) is a German lawyer and was a judge at the Federal Court of Justice from 2009 to 2016 .

He studied law at the University of Tübingen . After passing the second state examination in 1978, he entered the higher judicial service of the state of Baden-Württemberg and was initially a public prosecutor at the Stuttgart public prosecutor's office . In 1981 he was appointed to the Baden-Württemberg Ministry of Justice , for which he worked until 1992. There he was appointed government director in 1984 and senior public prosecutor in 1987. From 1988 to 1990 Mayer was seconded to the Ulm Public Prosecutor's Office as head of department , which was followed by a brief activity at the Stuttgart Public Prosecutor's Office . From 1992 to 1994 he was seconded to the Saxon State Ministry of Justice and the Bautzen Public Prosecutor's Office. After his appointment as senior public prosecutor in 1994, he returned to Stuttgart and took over the post of deputy head of the Stuttgart public prosecutor's office, before he became head of the Hechingen public prosecutor's office from 1997 onwards. From there he moved to the Stuttgart Higher Regional Court in 1999 as presiding judge of a criminal senate , and was appointed vice-president on January 1, 2002.

On July 1, 2009, Mayer was appointed judge at the Federal Court of Justice and assigned to the 3rd Criminal Senate, which is primarily responsible for state security criminal matters and for appeals from the districts of the higher regional courts of Celle, Düsseldorf, Oldenburg and Koblenz. He worked there until he retired on September 30, 2016.

Together with Otto Rudolf Kissel , Mayer is the author of the leading commentary on the Courts Constitution Act. As an expert for GTZ , he contributed to the establishment of a judiciary based on the rule of law in Eastern Europe. Mayer is married and has two children. Due to his interest in the countries of the Middle East, he is proficient in the Arabic language .
