Heribert Heckschen

Heribert Heckschen (* 1959 in Düsseldorf ) is a German notary , honorary professor at the Technical University of Dresden and honorary consul of the Grand Duchy of Luxembourg .

Life

Heckschen is the second of three children of the lawyer Guido Heckschen and his wife Ingeborg Heckschen. In 1978 he passed his Abitur at Görres-Gymnasium (Düsseldorf) . Heckschen studied at the Albert-Ludwigs-University of Freiburg im Breisgau law . During his legal traineeship in Düsseldorf and Karlsruhe, he completed his doctorate with Harm Peter Westermann . After the second state examination, he was admitted to the bar and, like during his traineeship, worked for the lawyer at the Federal Court of Justice, Georg Rößler, and then for Eilert Osterloh as a freelance lawyer. In 1986 he followed a short course in the USA and began his time as a notary assistant in the Rhenish notary's office (including with notary Wolfgang van Randenborgh, Düsseldorf). In 1990 he was appointed notary in Dresden with Oswald van de Loo. Heckschen is married, has four children and is Catholic.

Research and projects

Since 1988 Heckschen has mainly dealt with issues of corporation law, inheritance and insolvency law in publications . The focus was on issues of corporate and transformation law as well as stock corporation law and GmbH law, and increasingly in the area of corporate succession .

Publications and publications

After completing his doctorate, Heckschen wrote the monograph on the "Merger of corporations" and the monograph "The MoMiG in notarial practice" published by Verlag CH Beck on the question of the "formal requirements for indirect real estate transactions". In 2006, he published the joint work "Insolvency Law in Notarial Kautelarpraxis", written with Adolf Reul and Rüdiger Wienberg, at the CH Beck publishing house, which was newly published in 2018 in a significantly expanded scope under the title "Insolvency Law in Design Practice". He is also the editor of the Memento legal manual special on the "Private Limited Company". Heckschen is a co-commentator of the standard work “Widmann / Mayer, Transformation Law” as well as the “Kölner Schrift zur neue Insolvenzordnung”. He is also co-author of the comment “Burandt / Rojahn, Erbrecht” published by the CH Beck publishing house. In the manual of partnerships (publisher H.-P. Westermann ) he is the author of the section “Conversion of partnerships” as well as all of the annotated contract models and the chapter on choosing the right type of company. In the work “Mediation in Notarial Practice” Heckschen deals with the subject of “Mediation and Company Law”. Lecturer and teaching activities

Since 1988, Heckschen has given lectures on issues of corporate and partnership law, transformation law and corporate group law , company acquisitions and corporate succession , insolvency and international private law, as well as problems in the area of ​​commercial property law and inheritance law, as well as power of attorney . He has been leading the annual corporate law conference for the Association of German Lawyers' Institute since 2002 and the conferences on transformation law and corporate acquisitions for several years. On behalf of various organizers, he trains lawyers to become specialist lawyers for commercial and corporate law and supervises advanced training events for specialist lawyers for insolvency law . Heckschen has been teaching at the Technical University of Dresden since 2007 and has been an honorary professor at the TU Dresden since 2011. For the Dresden International University (DIU) he has been working as a speaker and conference leader in the field of corporate law for years. Engagements

Heckschen is a member of the committee for commercial and company law at the Federal Chamber of Notaries, so-called patent notary of the German Notar Institute for the field of commercial and company law, member of the scientific advisory board, corporate law section at the German Notar Institute, member of the editorial board of the " Zeitschrift für die notarielle Advisory and Notarization Practice "and is responsible for commercial and corporate law. In 2011, Heckschen took part as an expert in the extended rapporteur's meeting of the Legal Committee of the German Bundestag on the occasion of the government draft of a third law amending the Transformation Act. As an arbitrator, Heckschen is in charge of arbitration proceedings at the Conciliation and Arbitration Court of German Notaries (SGH).
