Johann Tobias Carrach (born January 1, 1702 in Magdeburg ; † October 21, 1775 in Halle (Saale) ) was a German legal scholar.

Life

The son of the businessman Martin Carrach had first attended the old town high school and then the cathedral high school in his hometown . He studied from 1721 at the University of Halle , first the philosophical sciences, turned to law and received his doctorate in 1729 with the writing de ejuranda ejeratione bonae spei, seu de exiguo usu juramenti perhorrescentiae adversus judicem under Gasser to the doctor of law . Since the doctoral student and later professor of the Pandects in Jena Heinrich Brokes (1706 to 1773) in his doctoral thesis de juramento prohorrescentiae, ejusdemque usu practico, held in Wittenberg in 1730 under Augustin Leyser . Carrach's legal point of view had been disputed, he had the text Vindiciae dissertationis de ejuranda ejeratione bonae spei adversus differtationem quandam Vitebergensis appear in the following year .

Thereupon he became an associate professor of law in Halle on May 10, 1732 , was an assessor at the Schöppenstuhl in 1735 , and on June 14, 1738, he became a full professor of law and an associated assessor at the law faculty. After the death of Simon Peter Gasser , he rose in the ranking of the law faculty in 1746 and was adjunct to Johann Gerhard Schlitte at that time . In 1753 he was promoted to senior law school and was associated with the royal Prussian privy councilor. In August 1759 Carrach and his colleague Johann Ernst von Flörcke (1695–1762) were drawn into the Seven Years' War and taken hostage by the imperial troops. Both reached Nuremberg via Prague, where Flörke died and Carrach was liberated in 1762 by the Prussian troops led by General Friedrich Wilhelm Gottfried Arnd von Kleist (1725–1768).

When he returned to Halle, he became the first professor of law and thus full professor of the law faculty. Carrach had also taken part in the organizational tasks of the Halle University and was prorector of the Alma Mater in 1754/55 and 1763/64 . His only son, Johann Philipp (born August 30, 1730 in Halle; † around 1816) , comes from his marriage on November 28, 1729 to Auguste Sophie († February 12, 1750), daughter of the royal Prussian Kommerzienrat in Halle Johann August Schubart ) who also became a lawyer. One daughter married Heinrich Johann Otto König (1748–1820).
