After the defeat of the SPÖ in the state elections in Upper Austria in 2009 and the resignation of regional party leader Erich Haider , Ackerl took over both the party chairmanship of the SPÖ Upper Austria and the post of one of the two regional governors' deputies. In November 2013, he handed over the chairmanship of the party to Reinhold Entholzer . Ackerl left the state government on January 22nd, 2014. On January 23, 2014, Gertraud Jahn was elected as the new SP Social Councilor and Reinhold Entholzer as the new Deputy Governor.

On October 1st, 2013 Josef Ackerl referred to the new head of the Stronach club, Kathrin Nachbaur , in a Facebook entry as "Tussi" and thus triggered a new discussion about sexism in Austrian politics. He led a violent argument with the Schüssel-Grasser government, which he described in 2003 as the "rabble government". To allegedly Pharisee-like behavior - for example the criticism of the double salary of Josef Cap - he expressed himself negative.
