Joseph Winiwarter ; from 1846 Joseph Edler von Winiwarter (born April 14, 1780 in Krems , † January 18, 1848 in Vienna ) was an Austrian lawyer and university professor .

Life

family

Joseph von Winiwarter was the son of Johann Georg Winiwarter (born March 21, 1741 in Stratzing ; † unknown) and his wife Maria Justina (née Zösch) (born January 12, 1733 in Traunstein ; † unknown).

Joseph von Winiwarter was married to Franziska geb. Holfeld (1784-9 November 1833). They had ten children together, of whom we know by name:

  • Ludwig von Winiwarter (* 1814 - 22 November 1834);
  • Josef Maximilian von Winiwarter (born October 15, 1818; † 1903), Prof. Dr. jur., court and court advocate, married to Helene Bach (1818–1894). Her children were among others the doctors Felix von Winiwarter and Alexander von Winiwarter ;
  • Justine von Winiwarter (born July 6, 1819; † unknown);
  • Natalie von Winiwarter (* December 1, 1820; † unknown), married to Anton Kalmann (1808–1890), office director of the 8th Chamber of Lawyers;
  • Georg von Winiwarter (* July 21, 1822 in Lemberg; † July 2, 1902 in Graz), engineer and factory owner, married to Elisabeth Andrews (* 1830);
  • Mathilde von Winiwarter (* 1823 - September 1, 1839);
  • July von Winiwarter (born January 20, 1831; † December 16, 1905), married to Rudolf Lechner (1822–1895), court book publisher;
  • Cäcilie von Winiwarter (born February 20, 1831 in Vienna; † May 11, 1862 ibid), married to Johann Baptist Hochenegg (1814–1899), court attorney. Her sons were the technician Carl Hochenegg and the surgeon Julius von Hochenegg .

Education and career

He attended grammar school in Krems and studied philosophy and law at the University of Vienna ; on December 10, 1804 he received his doctorate as Dr. jur. and entered a law firm . At the same time he received a judge's office at what was then the state realities land registry and shortly thereafter passed the examination at the Lower Austrian Court of Appeal in order to receive the decree of eligibility for the civil judge's office .

Due to its good results in the teaching certificate, he received at the age of 26, on 27 September 1806, the professorship of Roman and Austrian civil law at the University of Lviv ; on February 20, 1827 he was promoted to the teaching post of Austrian civil law at the University of Vienna, where he remained until his death.

During his teaching activity in Lviv , he ran the book revision business and was appointed to the real director of the office on November 25, 1810. From 1811 he held the position of advisor at the academic senate , later with simultaneous leadership of the university syndicate and notary's office . In 1818 he was rector of the university.

After his transfer to Vienna in 1829 he was employed as a temporary censor for the legal subject ; in January 1847 he was promoted to Real Censor . He also took over the management of the University Library in Vienna , was a member of the board of directors and consultant of the Vienna General Institute for Widows and Orphans from 1831 to 1845, and its director from 1845 until his death.

Writing

Joseph von Winiwarter published numerous writings, essays and scientific papers in the relevant journals, including in Carl Joseph Pratobeveras published materials for law and justice and in the Annalen der Rechtsschehrsamkeit published by Anton Rosbierski (1764–1815) .

His writing & # 152; Das & # 156; Austrian civil law appeared in two translations in Italian, one in Venice in 1837 by Giuseppe Antonelli (1793–1861), the second by A. Callegari also in Venice in 1838.

Honors

  • In March 1822 the emperor appointed Joseph Winiwarter to the government council.
  • In 1826 he was promoted to the Real Government Council.
  • On July 31, 1827, the magistrate made him an honorary citizen of Lemberg.
  • With the resolution of October 25, 1845 and May 30, 1846 and the diploma of August 5, 1846, he was raised to the hereditary nobility with the predicate noble of .
