Kerstin Nicolaus (born February 8, 1961 in Kirchberg ) is a German politician ( CDU ). She has been a member of the Saxon state parliament since 1994 .

Life and work

After completing the tenth grade at the POS, Nicolaus completed an apprenticeship as a ladies' tailor between 1977 and 1979 . She then worked at VEB Stola Bärenwalde, from 1981 in the function of a department manager . Between 1982 and 1985 she trained to become a master tailor and worked as an independent trader from 1988 .

Kerstin Nicolaus is Protestant and has four sons. In her third marriage, she has been married to the SPD MP Mario Pecher since 2014 .

Mayor and member of the state parliament

In 1989 she joined the CDU. In 1990 Nicolaus was elected full-time mayor of Hartmannsdorf near Kirchberg . After she was elected to the Saxon state parliament via the state list in 1994 , Nicolaus has represented the constituency of Zwickauer Land 1 since 1999 . Since 1994 Nicolaus has continued the mayor's office in Hartmannsdorf on a voluntary basis. Nicolaus has chaired the social, health, family, women and youth working group of the CDU parliamentary group since 1999 . At the same time, she has been spokeswoman for social and health policy for the group since then. During the 4th electoral term (2004–2009) Nicolaus was a member of the state parliament committees for school and sport as well as for social affairs, health, family, women and youth. In the 5th electoral term she is again a member of the Committee on School and Sport.

In the state elections in Saxony in 2019 , she was elected constituency member in the constituency of Zwickau 1 with 39.7 percent of the direct votes.

Flood aid affair after floods in 2002

In connection with the flood of August 2002 , it hit the headlines when it became known that it was using flood aid funds to replace the flood-damaged container building of the community sports home with a massive new building. Furthermore, it was proven that they also misused flood aid funds after private property sales for the expansion of the larch path from the field path to the street. After being convicted of fraud by the Zwickau District Court with a fine of 3330 €, Nicolaus was given leave of absence from her service as mayor by the Chemnitz Regional Council on January 8, 2008 . This decision was confirmed on February 1, 2008 by the Chemnitz Administrative Court. Another procedure because of the road expansion was discontinued.

Although she did not run in the local elections on June 8, 2008 , Nicolaus was elected mayor of Hartmannsdorf with over 70% of the vote. She clearly prevailed against the only candidate standing for election, the incumbent mayor Rolf Dittrich. Previously, the citizens of the community had been asked in an anonymous letter to include Kerstin Nicolaus on the ballot papers. On August 1, 2008, she returned to her office as mayor.

After the municipality of Hartmannsdorf had reclaimed 79,000 euros from Nicolaus for the expansion of the Lärchenweg, they sued the municipality at the administrative court in Chemnitz. Your lawsuit was dismissed. She fought legal aid before the Saxon Higher Administrative Court in Bautzen.

Affair about travel expense reports

Because of allegations of fraud in connection with billing for business trips in more than 400 cases, the public prosecutor applied for the waiver of their immunity in May 2008 . On July 1, 2008, the immunity committee of the Saxon state parliament passed the resolution to carry out a search in the course of investigations into breach of trust. On July 10, 2009, the Zwickau public prosecutor applied for a penalty warrant for fraud in 421 cases. At the beginning of April 2010, the public prosecutor announced that only a reduced number of cases would be investigated against Nicolaus. The penalty order for 421 cases was withdrawn after an examination. In May 2010, the Zwickau District Court issued a penalty order in the amount of 3500 € for fraud in 85 cases of double travel expense accounting , which Nicolaus also accepted. The Chemnitz regional office is examining the necessity of legal consequences.
