Yukos auction and review of 2005 sales contract

After successful civil lawsuits from shareholders before the Permanent Court of Arbitration in The Hague, the applicants were awarded 50 billion US dollars (37.2 billion euros) in a judgment of July 28, 2014, which the Russian government has to pay from the beginning of 2015. In 2013, Yukos Capital filed a motion in the U.S. District Court for the Southern District of New York to uphold a $ 42.1 billion award against Rosneft . Samaraneftegas has refused to pay since 2007.

On July 28, 2014, the Permanent Court of Arbitration made the decision with the arbitrators Yves Fortier (attorney) , Judge Stephen Myron Schwebel from the USA (appointed by Russia) and Charles Poncet (Switzerland) (appointed by the plaintiffs) in an approximately 600-page round Judgment. They awarded the majority shareholders 50 billion US dollars at the expense of Russia - which was half of their claim. The court unanimously found that an expropriation had taken place with which Russia, in violation of Article 13, expropriated the Yukos oil company in a series of politically motivated attacks based on (1) the Energy Charter Treaty. The arbitrators said Russia was driven by the auctioning of its core business, but not by motives for collecting taxes - due to the government's desire to acquire Yuko's "most valuable asset."

The main beneficiaries of just over 40 billion US $ from the arbitrator's verdict are Leonid Newslin, owner of ~ 70%, GML Director Tim Osborne , as well as 4 ex-Yukos owners Platon Lebedew , Mikhail Brudno , Vladimir Dubov and Vasily Shakhnovsky (each ~ 7, 5%). Mikhail Borisovich Khodorkovsky signed his majority stake in Yukos on Newslin during his trial in 2005 in an effort to repel the attack on the company. Other key beneficiaries are the Veteran Petroleum Pension Fund for 30,000 former Yukos employees, which received $ 8.2 billion from Russia. The possibility of claims settlement outside of the courts in the Netherlands is limited to technical issues. If Russia refuses to pay, plaintiffs may seize Russian state assets through court-ordered seizures in the 150 countries of the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards , which the Soviet Union acceded on August 24, 1960.

The judgments of the arbitral tribunal were overturned on April 20, 2016 by a state court in The Hague.
