Mark Karlheinz Binz (born July 10, 1949 in Wiesbaden ) is a German legal scholar and lawyer .

Life

After studying law in Berlin , Hamburg and Geneva doctorate Binz with the theme "Commitments in the founding stage of GmbH & Co " for Dr. iur. utr. at the University of Cologne . This was followed in 1977 admission as a lawyer , in 1979 admission as a lawyer specializing in tax law . Since 1987, Binz has been running the law firm Binz & Partner, which specializes in family businesses , as a senior partner. Binz is a member of the Economic Council of the CDU , the Association of Family Entrepreneurs , and the specialist tax consultant institute in Cologne. In December 2014, Binz was appointed Honorary Consul of the Eastern Republic of Uruguay by the Federal Government .

Binz is an expert in family businesses and is particularly active in the area of corporate succession as an author of specialist publications, as a legal scientist and lawyer. From 1996 to 2008, Binz held a teaching position for corporate succession at Heilbronn University , where he was made an honorary professor in 2001 . In 2011, Binz founded the Stuttgart Institute for Family Businesses (IFF).

Binz is a member of numerous supervisory bodies , including as chairman of the Fielmann supervisory board, as deputy chairman of the supervisory board of Faber-Castell and, for many years, as chairman of the supervisory boards of Jung von Matt , Kirchhoff , Moksel , Steffen and Wormland .

As a lawyer, Binz was active in prominent cases. At the beginning of the 1990s, he and his partner Martin H. Sorg unsuccessfully led several test cases against Lufthansa to protect non-smokers until the airline issued a general smoking ban on domestic flights. In 2000, Binz and Sorg started the so-called Mannesmann trial with a criminal complaint for breach of trust and corruption against Klaus Esser , the former CEO of Mannesmann , and a subsequent complaint procedure to the public prosecutor.

Binz also appeared publicly in the context of family disputes at Voith , Haribo , Electronic Partner (EP) , Heitkamp & Thumann and Breuninger . Until May 2016, Binz represented Robert Tönnies in a dispute with his uncle Clemens Tönnies over the family group Tönnies Lebensmittel .

The press and those involved in the process repeatedly criticized Binz. The lawyer magazine Binz and his colleague Sorg initially assumed that they had initiated the Mannesmann trial less for reasons of civic responsibility than for reasons of self-promotion. In a later issue, however, the same magazine characterized the work of Binz and Sorg in the Mannesmann trial as well-founded, persistent and the work of professionals. According to Capital magazine , insiders criticized Binz's approach in individual disputes. Binz was therefore more of a "war leader" than a mediator. However, according to Capital, other voices admitted that this particular strategy was also part of Binz's success.
