Michael Kloepfer (born September 1, 1943 in Berlin ) is a German legal scholar .

Life

Kloepfer studied law at the Free University of Berlin from 1962 to 1967 , did his doctorate in law under Peter Lerche on questions of fundamental rights dogmatics in 1969 and in 1973 he received his habilitation on the preliminary effects of laws at the University of Munich . From 1974 to 1976 Kloepfer was professor at the Free University of Berlin , from 1976 to 1992 full professor at the University of Trier . There Kloepfer was also director at the Institute for Environmental and Technology Law (IUTR).

From 1977 to 1996 Kloepfer was a part-time judge at the Higher Administrative Court of Rhineland-Palatinate .

1 November 1992 until his retirement in September 30, 2011 Kloepfer held the Chair of State and Administrative Law , European Law , Environmental Law and Finance and Business Law at the Humboldt University of Berlin held. His research areas also include technology law, IT law and disaster law .

Work and positions

In the 1990s Kloepfer played a key role in the development of the professors' draft and the commission's draft for an environmental code. Kloepfer also dealt with the systematization of environmental law in numerous scientific publications, in particular in his textbook on German environmental law. Michael Kloepfer is the editor of the publications on environmental law (SUR).

In the context of his work on constitutional dogmatics, Kloepfer devotes himself primarily to questions of constitutional development and constitutional perfection. In the field of fundamental rights dogmatics , Kloepfer made contributions to contouring the idea of ​​the protection of fundamental rights as a guarantee of constitutional requirements, building on his dissertation “Fundamental rights as a safeguard against the creation of existing rights” (1970) . His post-doctoral thesis “Vorffekt von Gesetze” (1974) is devoted to the constitutional dogmatic mastering of the actual effects of legislative proposals.

In addition, Kloepfer is pushing for a structural strengthening of parliamentary participation vis-à-vis the executive . Kloepfer criticized the way in which Chancellor Angela Merkel made decisions on the accelerated nuclear phase-out after the nuclear disaster in Fukushima in 2011 and on the refugee crisis in 2015/2016 from a legal perspective, in particular with regard to the rule of law (Art. 20 para. 3 GG) and parliamentary scrutiny.

A basic idea that pervades Kloepfer's work on administrative law and constitutional law alike is increased attention to informal and indirect forms of sovereign action (indirect behavior control). In constitutional law, for example, he examined the handling of "undesirable parties " (2016), in financial constitutional law the permissibility of socially responsible, "controlling fees " (1972) and, in particular, in environmental law various instruments of indirect behavior control (such as information trading , levies , certificate trading ).

Michael Kloepfer Prize

The Institute for Environmental and Technology Law (IUTR) has been awarding the Michael Kloepfer Prize every two years since 2012, each endowed with € 4,000. The aim of the award is to honor German-language, jurisprudential monographs that pioneering environmental and technical law. At the same time, the award serves to promote interdisciplinary cooperation.
