Bourges Pragmatic Sanction

The Pragmatic Sanction of Bourges is a decision of Charles VII of France published in Bourges on July 7, 1438 in agreement with the clergy gathered there . By acting as guardian of the rights of the Church of France , the king's decision limited papal power on several points:

  • The French Church recognizes the primacy of general councils over the Pope ( conciliarism ).
  • It supports the decisions of the Council of Basel .
  • The king has a say in elections for bishops and the filling of chapters in abbey churches by recommending candidates.
  • The church receives rights in relation to church income (abolition of annates ).
  • Rome's power in excommunications and interdicts is restricted. Papal edicts require royal approval.

The Pragmatic Sanction laid the foundations for the French national church . Although Eugene IV protested against it, it was valid until the Bologna Concordat adopted at the 5th Lateran Council (1516). In the years after its resolution, it was the subject of political disputes with several church leaders.

Louis XI. because of his Italian policy, suspended the Pragmatic Sanction of Bourges in 1451, which had been issued by his father, but the Estates General did not agree. Jean de La Balue , who received the cardinal dignity , was involved in the (intended) repeal .

Louis XII. of France renewed the validity of the legal basis from 1438, but in 1513 was ready to accommodate. The Bologna Concordat between Leo X and Francis I granted the respective French ruler (only) certain privileges with papal approval. The papal bull Pastor aeternus gregem of December 19, 1516, published parallel to the Concordat, expressly repealed Bourges' pragmatic sanction and underlined the primacy of papal decisions in church matters.
