Reinhard Birkenstock

Reinhard Georg Birkenstock (born December 24, 1944 in Dillbrecht , today Haiger -Dillbrecht; † June 13, 2018 ) was a German lawyer who specialized in criminal defense .

Live and act

After graduating from high school in 1965 at the Städtisches Jungs-Gymnasium am Löhrtor in Siegen, Birkenstock studied law in Lausanne , Heidelberg and Bonn and graduated in 1971 with the first state examination. He worked as a trainee lawyer in the higher regional court district of Cologne and passed his second state examination there in 1975. In 1999 he trained to become a specialist lawyer for criminal law and was awarded a doctorate in 2004 at the Philipps University of Marburg on the subject of "The definiteness of criminal offenses with indefinite legal terms: using the example of the violation of the traffic ban on questionable drugs with special consideration of the Federal Constitutional Court". jur. PhD.

Birkenstock has been working as a freelance lawyer in Cologne since 1975. At the end of the 1970s he became known for his mandate in the Herstatt Bank suit. In 1995 and 1996 Birkenstock defended Karl Wienand , the former parliamentary manager of the SPD parliamentary group, who had been accused of espionage for the GDR . He took on other high-profile mandates in the proceedings surrounding the Gerling insurance group and in the party donation scandal of the Cologne SPD .

Birkenstock was appointed defense lawyer for the TV meteorologist Jörg Kachelmann in the Kachelmann trial for rape allegations of a woman until Kachelmann surprisingly separated from him and on November 29, 2010 hired the Hamburg lawyer Johann Schwenn to defend him. In a civil proceeding before the Cologne Regional Court, Kachelmann demanded that the 37,500 euros that had been paid in excess of the originally agreed 250,000 euros be returned. Birkenstock, on the other hand, successfully claimed another 14,865 euros.

Birkenstock defended the art forger Wolfgang Beltracchi in 2011 ; Birkenstock's son Arne made a documentary about the case. In 2012, Birkenstock represented 15 former employees of the Envio company in the indictment against the owner Dr. Dirk Neupert and other executives for willful bodily harm. According to the public prosecutor, Envio put a large number of people at risk of damage to their health through illegal poisoning.

Birkenstock was a long-time member of the SPD , for which he also sat on the council of the Hürth community in the 1970s . He was married, had six children and last lived in Cologne . His oldest son is the filmmaker Arne Birkenstock .

He died on June 13, 2018 at the age of 73 after a serious illness.
