Ricardo Lumengo (born February 22, 1962 in Lussenga, Uíge , Angola ) is a Swiss politician ( SLB , previously SP ).

biography

Raised in Angola, Ricardo Lumengo fled his native country in 1982 at the age of 20 because he was persecuted as a politically active student. He was a member of JMPLA, the youth division of the MPLA , and belonged to the critical wing. Lumengo immigrated to Switzerland via Portugal, where he was granted asylum . There he received a residence permit after a few years . Lumengo is a citizen of Angola and a Swiss citizen since 1997 and lives in Biel .

Lumengo speaks French , German , Portuguese , English , Spanish and the Bantu languages Kikongo , Kikongo ya Leta and Lingála . He studied at the Faculty of Law at the University of Freiburg and is now a legal advisor for the Biel-Lyss-Seeland trade union federation and the Multimondo intercultural meeting center in Biel. He is the father of two children. In addition to Swiss citizenship, Lumengo also has Angolan citizenship.

Party affiliation

Ricardo Lumengo was a member of the SP Switzerland from 1996 until he left the party in November 2010 . On June 16, 2011, he announced that he had joined the Social-Liberal Movement and that he wanted to run for this party in the 2011 National Council elections .

Lumengo was elected to the city council of the municipality in which he lived in Biel in 2004. In 2006 he made the leap to the Grand Council of the Canton of Bern , where he was a member of the députation, the justice commission and several financial committees. In the elections of October 21, 2007, Ricardo Lumengo was the first time a former asylum seeker was elected to the National Council. He was the first member of the National Council with both parents from Africa. His choice was also recognized internationally. Lumengo was a member of the Security Policy Commission until the end of 2009 and was a member of the Foreign Policy Commission until 2011. In the elections on October 23, 2011 , he was not re-elected and his party did not get a seat.

Viewpoints

As a national councilor, Lumengo set priorities in the fight against unemployment, for more social justice and for the rights of foreigners. He campaigned for the employment of people of foreign origin in public administration - this as part of the implementation of the UN Racial Discrimination Convention , which Switzerland joined in 1994.

In the Grand Council of the Canton of Bern, he campaigned for a renewal of the Federal Thanksgiving, Penance and Prayer Day .

Lumengo showed its commitment to health policy by submitting a motion calling for an information campaign on the consumption of caffeinated soft drinks, so-called energy drinks , for the primarily young consumer group. With this, Lumengo pointed out the problem of the regular consumption of caffeine and its health consequences such as nervousness and sleep disorders.

In addition, Lumengo campaigned for the exemption of partially disabled people from paying compulsory military compensation .

Victim of racist incidents

In autumn 2006, the party president of the Freedom Party of Switzerland (FPS), police director of Biel and Bernese Grand Council member Jürg Scherrer put into perspective an apology that he had made to black Africans regarding a defamation suit by the African community of Biel with an article on his party's blog. A racist cartoon was published alongside the article. Lumengo filed a criminal complaint.

In the run-up to the National Council elections, Lumengo received massive racist abuse in the FPS blog in July 2007 by National Council candidate Patrick Lohri. In addition, Willi Frommenwiler (FPS) used name jacking and registered the domain lumengo.ch . This led visitors directly to another blog entry by Lohri on the FPS website with the title "Lumengo Lies!". In addition to racist remarks, it was stated that the Freedom Party "found out about Lumengo's self-accident and his alleged hit-and-run through a reliable source and [had] made the story public. " The domain remained in the possession of Frommenwiler after a court order , but could no longer be redirected to the FPS website.

On June 9, 2007, Lumengo found himself being harassed by two drivers while driving from Bern to Biel at night on the motorway in the Lyss area - the driver behind him was pushing, the man in front did not let him overtake. When overtaking, he touched the guardrail, which damaged it and his vehicle. The former Bernese Grand Councilor Jürg Scherrer (FPS), then Police Director of Biel, accused him of hit and miss. Lumengo did not report the incident to the police.

In late summer 2007 Lumengo was mocked during a session of the Biel City Council of Delegates of the Freedom Party, by demonstratively those bananas and marshmallows ate and imitated monkey sounds. The Freedom Party denied any connection with Lumengo.

Since his election to the National Council, Lumengo has been the victim of racially motivated harassment several times, including in his speech on May 1st in Langenthal in 2008 , where he was pelted with bananas. In October of the same year, a member of the Nationally Oriented Swiss Party denounced him on its website with an insulting text and a racist caricature. In general, Lumengo usually received racially motivated letters after a press presence.

Alleged election fraud and acquittal

Lumengo was accused of election fraud . He was exonerated from the suspicion of falsifying 47 ballot papers in the 2007 National Council elections. On November 11, 2010, Lumengo had to answer to the court in Biel for the suspicion of having filled out 44 ballot papers himself in the 2006 Grand Council elections - 42 of which were declared invalid. According to media reports, Lumengo denied these allegations. He helped new voters who were overwhelmed when filling out the ballot papers. His defense lawyer therefore pleaded for acquittal. However, Lumengo was found guilty of intentional election fraud by the district court in Biel - a novelty in the legal history of Switzerland. His lawyer put citing one. The SP of the Canton of Bern and the SP Switzerland called on Lumengo to resign from his National Council mandate. Lumengo was disappointed with his party's hasty calls for resignation and left the SP. Parliamentarians from other parties also consistently rated election fraud as problematic, but did not demand any direct parliamentary consequences.

In the second instance, Lumengo was acquitted on May 18, 2011 by the Bernese Higher Court of the allegation of election fraud . The Bern Public Prosecutor's Office filed a complaint against this acquittal, which brought the charge before the Federal Supreme Court . The unanimous judgment of the criminal law department of the Federal Supreme Court in February 2012 supported the acquittal of the Bern Higher Court and dismissed the complaint of the Bern Procurator General. The Federal Supreme Court left it open as to whether the offense of capturing votes had been fulfilled, as this offense was statute-barred. Lumengo is therefore considered innocent in the final analysis.
