Rudolf Machacek

Rudolf Machacek (born December 28, 1927 in Vienna ; † October 6, 2014 ) was an Austrian lawyer and constitutional judge . Machacek was a member of the Austrian Constitutional Court from 1971 to 1997 .

Career

Rudolf Machacek was born on December 28, 1927 in the Austrian capital Vienna, where he also attended the secondary school. Even before he finished school, Machacek was drafted in 1943 at the age of 16, first as an air force helper , then for the Reich Labor Service and finally for the Wehrmacht . He was taken prisoner of war , from which he did not return to Vienna until 1946 in order to catch up with the Matura . Following this, he began his studies of law at the University of Vienna , which he in 1950 with the promotion of Doctor of Laws graduated (doctorate.). At the same time, he also passed the teaching qualification test for English as a subject .

Machacek completed his legal practice and subsequently joined his father's law firm as a trainee ( trainee lawyer). In 1957 he passed the bar exam and was then entered on the bar list, which he remained until his retirement in 1993. From 1963 to 1991 Rudolf Machacek acted as General Secretary of the Austrian Legal Commission and from 1991 as its Vice President. Between 1969 and 1984, Machacek held several different professional representation functions within the Bar Association, for example as a delegate to the Austrian Bar Association and as a member of the examination committee for bar examinations.

On December 29, 1971 Rudolf Machacek was appointed as a member of the Constitutional Court by Federal President Franz Jonas on the proposal of the National Council . Subsequently, from January 1, 1979, he was also one of the elected permanent speakers at the VfGH. On September 30, 1997, and thus only three months before his constitutionally required retirement, Machacek resigned from the Constitutional Court. On October 1, 1997, he subsequently accepted the position of legal protection officer for special investigative measures under the Code of Criminal Procedure in the Federal Ministry of Justice . After he was reappointed in this role in 2000, he was appointed deputy legal protection officer in 2003.

On September 12, 1989, Machacek was elected by the Committee of Ministers of the Council of Europe to be a member of the European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment . After being re-elected in 1993, he held this position until 1997. In 1994, Rudolf Machacek also accepted an honorary professorship for constitutional jurisdiction and fundamental rights at the University of Linz .
