Bau- und Liegenschaftsbetrieb NRW (BLB NRW) is a special fund of the state of North Rhine-Westphalia with partial legal capacity and its own economic and accounting management. Basics

North Rhine-Westphalia's real estate management is based on the tenant-landlord model. Gabriele Willems and Marcus Hermes are the managing directors of the construction and real estate company NRW. criticism

In 2011, an investigation by the State Audit Office in Düsseldorf led to investigations by the public prosecutor's office in Wuppertal against employees of the BLB NRW. The investigation focuses on overpriced land purchases by BLB NRW and the resulting allegations of corruption. In July 2015, the Wuppertal public prosecutor brought charges, including against ex-SU boss Ferdinand Tiggemann, on suspicion of infidelity and corruption. In February 2017, the Düsseldorf Regional Court sentenced Tiggemann to more than seven years in prison. According to the prison sentence, Tiggemann had used his insider knowledge about state-owned construction projects in North Rhine-Westphalia for years to enrich himself. Through a straw man, he had properties that the land wanted to acquire bought for large sums - so that SU then had to pay far more in order not to endanger the construction projects. Tiggemann is said to have made a significant contribution to the difference. Tiggemann was arrested in the courtroom immediately after the verdict. The judgment is now final.

In August 2015, BLB NRW itself filed a criminal complaint against former persons responsible for real estate transactions around Campus West in Aachen. The “Campus West” expansion site was targeted by the Wuppertal public prosecutor's office, as the purchase price of over 50 million euros that had been paid seemed excessive in view of the contaminated sites on the property. In June 2018, RWTH Aachen University acquired the area from BLB NRW. It was agreed not to disclose the purchase price, which was determined by an appraisal.

In the 15th electoral period there was a committee of inquiry into the BLB NRW, which ended because of new elections and was resumed in the 16th legislative period.

The parliamentary committee of inquiry of the North Rhine-Westphalia state parliament dealt with questions - mostly on real estate transactions and decision-making processes - at the state archive in Duisburg, the police headquarters in Cologne-Kalk, the Kellenberg castle, the state authorities in Bonn, the Vodafone high-rise in Düsseldorf and a planned new building for the Cologne University of Applied Sciences. After the fire in Schloss Kellenberg in the Düren district on April 1, 1992, the ruins were acquired at the beginning of 2009 for two million euros, as well as other properties in the area for 1.1 million euros from the construction and property company of North Rhine-Westphalia (BLB). During the construction of the State Archives in Duisburg , the committee dealt with exploding costs (200 million euros instead of the originally announced 52 million euros). According to BLB NRW, the first investment decision by its board of directors in 2008 already provided for construction costs of around 140 million euros.

In a special report on budgetary and economic management at BLB NRW, the State Audit Office of North Rhine-Westphalia calls for, among other things, more flexible financing and investment management and the further development of strategic planning and controlling instruments. There had already been a committee of inquiry into the BLB NRW in the previous electoral term, which ended due to new elections and was resumed in the new legislative term. A holistic strategic planning of the state property management according to customer groups as well as a new system for rent calculation and a new determination of the existing rents. The findings of the State Audit Office of North Rhine-Westphalia are based on an investigation of 125 investment projects by BLB NRW from 2012 and 2015.

Among other things, there were delays in the construction of the major projects at the University of Health , Düsseldorf University Hospital and Bielefeld University of Applied Sciences in connection with the building equipment supplier Imtech . The CDU MP Christian Haardt criticized in 2015: "At the HSG, you have to ask yourself in particular how it can be that an entrepreneur who has proven to be unsuccessful in other SU major projects was able to win the contract again." Haardt feared "incalculable costs". Imtech is suspected of deliberately delaying the completion of projects in order to achieve higher prices in renegotiations. In 2014 BLB NRW terminated a large part of its contracts with the company.

The completion date for the Bochum Justice Center at the end of 2015, which was scheduled for the start of construction, must be postponed by one year. The budget will be exceeded by at least 38 million euros. The costs have risen due to company insolvencies, rescheduling and award complaints, among other things.

Realignment

In their concluding remarks on the findings on budgetary and economic management at BLB NRW, the auditors of the State Audit Office in 2018 stated that BLB NRW shared their assessments and announced appropriate packages of measures, provided that the required readjustments can be implemented internally. In addition, on September 11, 2018, the NRW state cabinet decided on overarching structural changes in order to initiate a "[...] system change in real estate management in the state", as Minister of Finance Lutz Lienenkämper said. “This finding also agrees with the internal analysis of SU, which has already initiated the first important steps. The last major reform of the BLB NRW was passed in 2014 by the then red-green state government. With the resolution of so-called key points, it initiated the second stage of the realignment at the time, which began in 2010 with the dismissal of the managing director Ferdinand Tiggemann.
