Fire Brigade Act (Austria)

The fire brigade laws in Austria, like the entire fire brigade system , fall within the competence of the federal states . This means that the relevant legislation also falls within this legislative level.

The scope of the laws varies from state to state. While in some federal states the law only affects the fire brigades themselves, in other federal states it also regulates preventive fire protection and the assistance of the general public.

In all fire brigade laws, the organizational forms of fire brigades in the respective federal state are fundamentally specified. These laws can result in ordinances from the federal state or individual municipalities that affect the general public. These are primarily regulations that relate to preventive fire protection , especially how the fire inspection is to be carried out. Fire protection in the building sector or in the commercial sector is not affected. Also not included are regulations for the event of a disaster. These are regulated in separate disaster control laws.

Regulations resulting from the respective laws, which only affect the fire brigades themselves, are decided by the respective state fire brigade associations .

Fire extinguishing regulations were predecessors to the fire brigade laws at a time when there was no talk of organized fire brigades. The oldest known fire extinguishing regulations date from 1221 from Vienna and from 1222 from Enns .

In 1722, Emperor Charles VI. the deletion regulations for the Duchy of Styria and the inner Austrian regions . While the Theresian Fire Code again mainly referred to Vienna, her son Joseph II published the Josephine Fire Code in 1782 for the rural towns and for the open countryside in Lower Austria :

This ordinance subsequently became valid for all crown lands between 1785 and 1797 . In these fire regulations, which are read several times a year, emphasis was placed above all on the fire inspection .
