A dangerous event in relation to rail vehicles is a rail accident or a dangerous irregularity that either affects or endangers moving rail vehicles or is caused by moving rail vehicles .

Dangerous event is a fixed, precisely defined term in railway operations . It only includes events that are directly related to the “rolling wheel ”, that is, to moving railway vehicles . The German Federal Railway Authority (EBA) divides dangerous events into two categories:

Category 1 (railway accidents)

Category 2 (dangerous irregularities)

A dangerous irregularity is any event that affects the safety of railway operations in such a way that it could lead to an accident in the event of a specific hazard . It is available

a) always at:

  • Approach to the stop without consent

  • Driving past the stop concept without consent

b) only if there is a specific hazard:

  • Other dangerous event
  • Irregularity at the level crossing
  • Irregularity in railway vehicles
  • Irregularity with operational misconduct

c) in accordance with special laws and ordinances :

If an event can be assigned to both categories, category 1 is decisive. The initial event is decisive for the assignment within a category.

Report, investigate, report

Immediate reports to the operations control center are regulated internally by the RU and IM. In certain cases, an immediate report must be sent to the EBA 30 minutes after the occurrence of the event. Depending on the level of knowledge and requirements, additional reports will be sent later.

A report on the situation must be submitted by 7:30 a.m. on the following working day . Accidents at work are to be reported to the accident insurance institution within 3 days , regardless of the reporting channel for dangerous events according to SGB ​​VII . Collective reports are to be submitted within 14 days of the end of the quarter or the half-year or full-year period.

Every railway company is obliged to investigate dangerous events in its area of ​​responsibility. He can appoint an investigator. At DB AG, emergency managers are employed as heads of a delimited emergency area. The group guideline (KoRil) 123 "Emergency management, fire protection" regulates their tasks and competencies. In cases in accordance with Section 3 (2) No. 7 BEVerkVwG , the EBA undertakes the investigation.

If the investigator in charge of the investigation can see that the result of the investigation cannot be completed, this must be reported to the EBA branch office immediately with the reasons.

The investigating officer must secure and keep evidence to clarify the cause of the event or the question of guilt . He may only allow changes if they are absolutely necessary to save people or to avoid further damage to objects. The investigator must take suitable measures to ensure continued operational safety in the area surrounding the incident.

After completion of the investigation, a railway investigation report (with additional findings) or, in the case of selected events, a simplified railway investigation report must be prepared.

The railway investigation report is to be sent to the responsible EBA branch office after 4 weeks at the latest, without being requested to do so, 1. for all events that are reported as immediate reports; 2. for all events for which the cause is unclear; 3. in the event of an irregularity at the level crossing, if prescribed safety measures have failed or have been neglected; 4. if the Simplified Railway Investigation Report has not been received by the EBA within 72 hours; 5. at the request of the EBA in individual cases.

In all other cases (except accidents at work), a simplified railway inspection report must be sent to the EBA branch office after 72 hours .

The investigation is with setting modest EBA completed. The railway company must keep the inspection reports for at least 5 years. Information on dangerous incidents is included in the rail traffic accident statistics in accordance with Section 21 of the Traffic Statistics Act (VerkStatG). The necessary data is compiled by the railway company and sent to the Federal Statistical Office .

Differentiation of other irregularities, disruptions, accidents

Irregularities, disruptions, accidents and other events on the railway site or on or in rail vehicles are not dangerous events in the sense of the EBA instruction if they are not directly related to moving rail vehicles. That can be B. be the following:

  • Disruptions in the operational area

Until the 1990s, the Deutsche Reichsbahn was familiar with the term accident in its railway accident regulations (DV 423 -Buvo-), which included railway accidents, train hazards, other incidents, industrial accidents, accidents as well as property damage to passengers or other foreigners, wagon damage and fires.
