The Gesellschaft zu Kaufleuten is one of the 13 companies and guilds in the city of Bern and a public corporation guaranteed by the constitution of the Canton of Bern . It is a civil corporation within the meaning of Bernese municipal legislation and is subject to the supervision of the cantonal authorities. As a personal corporation, it does not have its own territory and is taxable. It includes all citizens of Bern who have the company law to become merchants. At present the Society for Merchants has about 1300 members.

The Gesellschaft zu Kaufleuten appears in the sources for the first time at the end of the 14th century as a shopkeeper society. Since 1431 at the latest, the company had the privilege of being the market and trade police in the German-speaking areas of the city ​​and republic of Bern . The company controlled measures and weights and exercised the actual market police through supervisors (Henseler). The privilege fell in 1798 with the French occupation of Bern.
