Heinz Holzhauer

Heinz Holzhauer (born April 21, 1935 in Bad Selters ) is a German lawyer and legal historian . He taught civil law and German legal history at the Westphalian Wilhelms University in Münster , where he was temporarily director of the Institute for Legal History.

Life

After graduating from high school in Darmstadt in 1955, Holzhauer studied law at the universities of Marburg and Freiburg im Breisgau . After the first legal examination in 1959, Holzhauer stayed at the university and worked as a faculty assistant and research assistant . After the second exam he was assistant to the legal historian Ekkehard Kaufmann . 1967 Holzhauer was with the dissertation The problem of free will in the penology of the 19th century and its importance to the doctrinal dispute doctorate . In the 1970/71 winter semester, he completed his habilitation in Marburg with the work The handwritten signature: History and dogmatics of the written form requirement in German law . After several professorships, he was offered a position in Münster in 1979 to succeed Rudolf Gmür . He taught here until 2000. Even after his retirement , Holzhauer held lectures at universities, including in Düsseldorf , Paris (Nanterre) and Moscow .

In the 1980s, Holzhauer and school friends founded a. a. Helmut Markwort , an amateur play group . The ensemble of lovers gave the traditional Darmstadt local posse Datterich by Ernst Elias Niebergall (1841) in several cities , most recently in 2015 at the Bad Hersfeld Festival under the direction of Dieter Wedel . Mathias Döpfner , Frank Lehmann and Hermann Otto Solms were guests at times . Holzhauer directed and took on the leading role.

Holzhauer's early work deals with the fundamentals of law, in particular with the history of criminal law and legal anthropology . With his habilitation thesis he attempted to combine legal history with the dogmatics of applicable law , which in the following years emerged as his characteristic way of working. Family law was a particular focus of applicable law . The design of today's legal institution of care is associated with Holzhauer's work. In addition, there are works that combine law and literature , e.g. B. on the law in Annette von Droste-Hülshoff's book on Jews or the representation of marriages in opera libretti .

In 2015, Heinz Holzhauer acted as an expert in the aristocratic dispute over the legal succession as head of the Albertine line of the House of Wettin . In a later lecture, Holzhauer took up the topic again and related it to the case law of the Federal Constitutional Court on inheritance law .
