Richard Josef Martinz (born February 14, 1959 in Villach , Carinthia ) is a former Austrian politician ( ÖVP ) who was sentenced to four and a half years of unconditional imprisonment for infidelity .

Life

Martinz attended elementary school in Ossiach and middle school in Villach and studied and obtained a doctorate in social and economic sciences at the Vienna University of Economics and Business . After military service with the Guard in Vienna , he became managing director of Martinz KG in Ossiach (camping, catering, trade) in 1982. He was involved in various functions in the Chamber of Commerce and in tourism committees.

Martinz is married to Sabine Martinz and has two sons. His younger son Christof Martinz is a professional ice hockey player with VSV.

Martinz is a member of KaV Saxo-Bavaria Prague in Vienna in the ÖCV .

politics

Martinz got into politics around 1980. In 1997 he became mayor of the municipality of Ossiach . In 2001 he became VP district party chairman for Feldkirchen in Carinthia .

From 2004 to 2012 he was regional party chairman of the ÖVP Carinthia and, as regional councilor for European affairs and agriculture, a member of the Carinthian regional government .

He was an alternate member of the Committee of the Regions (CoR). Martinz took part in the CoR plenary sessions and in the meetings of the ECOS (economic and social policy) and DEVE (sustainable development) commissions.

Josef Martinz was a board member of the Assembly of European Regions . Martinz was also a member of the Working Group on European Border Regions ( AEBR ). Martinz was also the Alps-Adriatic consultant for the state of Carinthia. Both the Alpen-Adria office and the general secretariat of the Alpen-Adria working group have their headquarters in Carinthia . From 2004 to 2006 Martinz was involved in the structural reform of the ARGE Alpen-Adria.

In January 2011, the incumbent agricultural council caused a sensation when he called for bears and wolves to be shot down. This statement was criticized not only by the political opponent, but also by the federal party leader of the ÖVP.

On January 16, 2012, Martinz resigned from the Carinthian state government because of the Hypo expert opinion scandal and Achill Rumpold succeeded him. On July 25, 2012 Martinz resigned as chairman of the ÖVP Carinthia and Gabriel Obernosterer succeeded him in this position.

Imprisonment after scandal in the appraisal of the sale of Hypo Group Alpe Adria

The regional council came under suspicion of abuse of office in connection with the sale of Hypo Group Alpe Adria .

On January 16, 2012, Martinz announced that he was resigning from his government office because charges would be brought against him in the so-called “expert opinion scandal”, which involved paying Dietrich Birnbacher 12 million euros for an expert opinion on Hypo Fee was reduced to 6 million after public pressure.

The Klagenfurt public prosecutor's office confirmed on March 22, 2012 that Martinz and other people would be charged. In the trial, which began on July 4, 2012 at the Klagenfurt Regional Court , Martinz pleaded “not guilty”.

Only after Birnbacher had confessed that it had been agreed to lead part of his - as he had previously admitted, far excessive - fee to Martinz 'ÖVP and Jörg Haider's BZÖ (today Die Freiheitlichen in Kärnten , FPK) did Martinz step in on July 25th Back in 2012 as ÖVP state party chairman and announced to leave the ÖVP. On October 1, 2012 Martinz was sentenced in the first instance for infidelity to a term of five and a half years of unconditional imprisonment. On March 11, 2014, the Supreme Court reduced the sentence to four and a half years of unconditional imprisonment. Martinz started the sentence he was serving in the Vienna Simmering prison on the last possible day, May 9, 2014, in the Klagenfurt prison . He was outdoors since the beginning of October 2014. In August 2015, he was granted an electronic ankle cuff . In April 2016, an application for early conditional release from electronically monitored house arrest was rejected for general preventive reasons. At the beginning of January 2017, however, the rest of the sentence was waived.

The European Court of Human Rights ruled on June 1, 2017 that the process did not constitute an unfair trial within the meaning of Article 6 of the European Convention on Human Rights .
