The state election in Schleswig-Holstein in 1954 was the third free election to the Schleswig-Holstein state parliament and took place on September 12, 1954 . The government made up of CDU , BHE and FDP was confirmed in principle, the SPD Schleswig-Holstein became the strongest force by votes , but not by mandates .

prehistory

After the state elections in Schleswig-Holstein in 1950 , the CDU politician Walter Bartram formed a coalition government made up of the FDP, DP and BHE. After less than a year, Walter Bartram had to resign and Friedrich Wilhelm Lübke (CDU) became Prime Minister . The FDP suffered a split in 1952 after Minister Hermann Andersen left . Four MPs left the parliamentary group of the electoral bloc and formed their own FDP parliamentary group. The other four initially formed a fraction of the “democratic collection” and later joined the CDU.

Suffrage

The threshold of 5% , which was only introduced in 1950, was tightened to 7.5% by the state election law of October 22, 1951. The SSW successfully sued this change in electoral law, the Federal Constitutional Court declared in its decision of April 5, 1952 that the threshold clause exceeding the “rule quorum” of 5% was unconstitutional ( BVerfGE 1, 208 ). The state parliament followed this decision with a resolution of October 28, 1952.

In the state elections in 1954, a blocking clause of 5% was applied, which could be circumvented by obtaining a direct mandate. While the SHB just managed to move into the state parliament with four seats with 5.1%, the SSW also failed with this quorum with only 3.5% of the votes. The SSW lost another lawsuit against the electoral law by decision of August 11, 1954 ( BVerfGE 4, 31 ).

The elected members of the Landtag can be found in the list of members of the Schleswig-Holstein Landtag (3rd electoral period) .

With the votes of the CDU, BHE and FDP, Kai-Uwe von Hassel was elected Prime Minister on October 11, 1954 . Friedrich-Wilhelm Lübke had previously announced his resignation for health reasons (he died five days later of cancer).

A conflict arose in the state parliament over the office of the president of the state parliament. Was elected Walther Böttcher (CDU), although the SPD had become by votes largest party. The coalition argued that it was a matter of mandates, not votes, who would become President of Parliament.
