Ayatollah Seyyed Mahmud Haschemi Schahrudi ( Persian محمود هاشمی شاهرودی; * August 15, 1948 in Najaf ; † December 24, 2018 in Tehran , Iran ) was an Iranian politician and Chief Justice from August 14, 1999 to August 15, 2009 and thus Chairman of the Judiciary of Iran.

The Iraqi Shahrudi, who moved to Iran after the Iranian Revolution in 1979 and was married to the daughter of Grand Ayatollah Mohammed Shahrudi, was considered a confidante of the revolutionary leader .

Positions

Hashemi Shahrudi caused a stir in 2002 when he declared that he had "taken over a ruin" when he took office in 1999. He also reprimanded the Iranian judiciary and called for the abolition of pre-trial detention:

“According to Islamic law, people who are suspected of murder can be held in custody for a maximum of six days. But in our prisons there are people who remain in custody for two to three years. "

He told the EU Commissioner for External Relations , Chris Patten , in February 2003 that the Islamic Republic would in future waive the death penalty by stoning . The European Union had long called for this step.

In the 2004 case of Atefah Sahaaleh , he also dismissed the defendants' appeal, which promptly and innocently executed. The reason for the appeal was, among other things, obvious procedural defects such as the concealment of the defendants' minority.

In the case of Makwan Moloudzadeh , whose execution was carried out on December 4, 2007 and who was 13 years old at the time of the alleged act, a stay of execution by Shahrudi was rejected by a court on the grounds that the court did not conduct an error or could discover on the death sentence. The case attracted international attention because by carrying out the execution, Iran violated international treaties and the UN Convention on the Rights of the Child , which prohibits the execution of minors at the time of the crime. Iran has signed these agreements and conventions. In 2007 alone, during Shahrudi's time in office, at least five people were executed in Iran who were minors at the time of the alleged crime.

The High Commissioner for Human Rights of the United Nations , Louise Arbor , reminded the Iranian authorities that Iran has signed the International Children's Rights Convention. One day after the execution of Moloudzadeh, Amnesty International asked Shahrudi to review the litigation methods that led to Moloudzadeh's death and to ensure that Iran complied with international treaties.

In the case of Delara Darabi , Shahrudi asked the Rasht appeals court to re-examine. The local authorities disregarded the two-month suspension of sentences issued by Shahrudi on April 19, 2009 - in order to give relatives of the victim the possibility of consent to the death penalty under Islamic law (see Diya ).

Treatment in Hanover

At the beginning of January 2018, Mahmud Haschemi Schahrudi received medical treatment at the International Neuroscience Institute in Hanover , and around 200 Iranians from abroad protested against him in front of the clinic building. His alleged bodyguard appeared at the entrance to photograph and film the participants in the peaceful demonstration. Schahrudi had received a visa for 30 days from the Foreign Office. After completing the treatment in Hanover, he was escorted to Hamburg Airport in a motorcade under police protection .
