Pieter Herman Bakker Schut (born March 31, 1941 in Haarlem , † October 13, 2007 in Amsterdam ) was a Dutch lawyer .

Schut was best known as a defense lawyer for members of the terrorist organization Red Army Fraction . He represented u. a. Ronald Augustin . During this time, he presented a comprehensive book and a collection of documents that were much discussed in the 1990s Left.

Life

He was the son of a senior Dutch official in The Hague and graduated from the First Liberal Christian Lyceum in The Hague in 1959 , studied for a year at Wesleyan University and from 1960 to 1965 law at Leiden University . He then did military service with the SMID military intelligence service in Harderwijk , where he also learned Russian before becoming a lawyer in Amsterdam. After he had committedly defended students who had occupied the Maagdenhuis in 1969 , he ran into difficulties in his law firm, where he was an intern. He moved to the law firm Goudsmit under Max Rood (1927-2001), who was also a university professor in Leiden and in 1982 was Minister of the Interior. At the same time he became known in the Netherlands as a committed television presenter in the program Kort Geding and was active in the criminal law reform and co-founder of the Coornhert League association . He drew up plans for a state-paid socialist collective of lawyers and came into conflict at Rood's law firm: it was made clear to him that he could not become a partner with it. Schut resigned and went to the Willem Pompe Institute at the University of Utrecht . He was now specialized in criminal law, although he said it was not his original inclinations; he had originally been interested in a career in corporate law, international law and the diplomatic service. However, he got stuck there after the negative experiences he had made in the Dutch criminal law in the 1960s with the treatment of suspects.

A turning point in his career at the beginning of the 1970s was the defense of member of the Red Youth Luciën van Hoesel, who was charged and imprisoned on the basis of weak evidence from the domestic secret service BVD . Schut called the head of the BVD to the stand to question him about failures of his authority. Although he refused to give a statement with reference to his official secrecy, Schut was successful in the process and was able to cast doubts about the BVD's approach. That was also the beginning of his engagement in the defense of left-wing extremists in West Germany, especially the trials against the RAF. In the 1970s he was a long member of an idealistic legal collective and in the 1980s he was a social lawyer in Amsterdam, where he co-founded the lawyers collective at Nieuwezijds Voorburgwal and provided legal counsel for the RaRa action group . In 1994 he and his future wife Adèle van der Plas founded their own law firm BSVDP on Prinsengracht , which specialized in criminal law. One focus was the defense of criminal drug offenses, for example the arms and drug dealer Mink Kok (Mink K.). His wife Adèle van der Plas was a communist and met him at the Pompe Institute in Utrecht, where she had written a dissertation on criminal law in Cuba.

Schut received his doctorate in 1986 at the Willem Pompe Institute of the University of Utrecht at AAG Peters on the Stammheim trial and completed his habilitation on this topic in 1997. His dissertation ( Political Defense in Criminal Matters , published in 1986 by Neuen Malik Verlag) analyzes the RAF trial in the context of the term political Justice by Otto Kirchheimer . He was also influenced by Michel Foucault and his power / knowledge concept. On the night of Stammheim's death , he maintained that various contradictions in the information provided by the authorities on the suicide of the inmates had not been cleared up. For this purpose, the theory of the murder of the prisoners by the German state is associated with his name: “de long arm van het Bundeskriminalamt”. Schut was best known as a defense lawyer for members of the Red Army faction .
