Rudolf Wirtz

Rudolf Wirtz (born May 31, 1931 in Opladen ; † May 1, 2003 in Wiesbaden ) was a German lawyer and administrative clerk , most recently in the rank of Senior Ministerial Councilor in the Hessian State Chancellery , as well as template for a fictional character in Martin Walser 's Finks War .

Life

Wirtz was born in 1931 as the son of a student councilor and reserve officer. He grew up in a Catholic-German national environment and had several siblings. His parents' house, however, was aloof from National Socialism . In 1949 Wirtz fell ill with tuberculosis and was treated repeatedly. It was not until 1952 that he was able to take his Abitur .

He then studied law at the University of Cologne and the Albert Ludwig University of Freiburg . In 1956 he passed the first state examination in law. During his legal clerkship , he also worked for a law firm in Tel Aviv , Israel , which was to be formative for him. He was on friendly terms with the German-Israeli lawyer Kurt Tuchler . In 1961 the second state examination and the practice as a lawyer in Düsseldorf followed .

In 1962 he worked at the Federal Office of Administration in Cologne . In 1963 he was appointed government assessor and in 1965 government councilor . For a short time he worked in the Eschwege District Office (1964). In 1966 he became a civil servant in the Hessian state service. In 1968 he was promoted to the Upper Government Council . In 1970 he became government director in the Hessian State Chancellery under Prime Minister Albert Osswald ( SPD ). From 1985 he was a senior ministerial advisor. He was initially responsible for the citizens' office and was later appointed head of the liaison office to the churches and religious communities. By the separation of state and church , he understood a “balanced separation”. During his tenure, he was responsible for drafting the contract between the State of Hesse and the State Association of Jewish Communities in Hesse - a public corporation (GVBl I, 395) and providing legal support for the degree course in Catholic theology at the University of Frankfurt am Main .

In 1988, Wirtz, a member of the SPD, was transferred to a less important function after Walter Wallmann ( CDU ) took office. In its place moved Wolfgang Egerter (CDU) to a fraction assistant to the new prime minister. The reason for the reshuffle was alleged complaints from representatives of the religious communities. It remains unclear to what extent these were applicable. Wirtz took legal action - unsuccessfully in the result - against the allegations that hurt his personal honor. These were confirmed in the extensive proceedings by an affidavit from Alexander Gauland (then CDU, now AfD ), who was then head of the state chancellery. It was only after Hans Eichel ( SPD ) took office in 1992 that he was reinstated as head of the liaison office to the churches and religious communities and was to hold this position until his retirement in 1996.

After his retirement he was a. a. Legal advisor to the International Council of Christians and Jews .

Finks war

Through his involvement in the Gauland affair , he became a model for the character of Stefan Fink in Martin Walser's novel Finks Krieg (1996), published by Suhrkamp Verlag . He provided the writer with collected documents. The legal scholar Rainer Wahl later analyzed the fictitious-real litigation in the Neue Juristische Wochenschrift (NJW).
