Sylvia Stolz

Sylvia Stolz (born August 6, 1963 in Munich ) is a former German lawyer from Ebersberg who is assigned to neo-Nazism . She became prominent as a lawyer, the Holocaust -denying right-wing extremists as Horst Mahler , Germar Rudolf , Rigolf Hennig and Ernst Zundel and himself as Holocaustleugnerin known and former partner of Horst Mahler. She herself was convicted several times of incitement to hatred and thwarting punishment , among other things , and was banned from her profession for a limited period. She is currently in custody.

Participation in criminal proceedings

As the defense attorney for Ernst Zündel, who was accused of Holocaust denial, among other things, Stolz caused quite a stir, as she repeatedly submitted or submitted applications, complaints and statements with incitatory content. If Zundel was convicted, she had threatened the two lay judges with the death penalty for “defamation of the people and favoring the enemy ”. She was then excluded from the trial. Pride was then carried out of the court by the police for defying the order. The exclusion was confirmed on March 31, 2006 by the Karlsruhe Higher Regional Court. It found that Stolz had "abused her defense task", sabotaged the procedure with "non-litigation behavior" and, despite the presiding judge's ban on speaking, made statements with "partially criminal Nazi content".

In the trial against Horst Mahler for showing the Hitler salute , Stolz, as defense attorney, made a plea of ​​more than three hours in which she again repeatedly denied the Holocaust and praised National Socialism.

Proceedings and judgments at the Mannheim Regional Court 2007–2009

In March 2007, the Mannheim public prosecutor brought charges against pride for incitement to hatred , coercion , attempted thwarting of punishment and the use of symbols of unconstitutional organizations . At the same time, a professional ban was sought. The trial began on November 15, 2007 at the Mannheim Regional Court . Pride has been accused, among other things, of denying the Holocaust. The proceedings were initially scheduled to run until the end of January 2008.

Sylvia Stolz's defender, Ludwig Bock , argued by referring to freedom of expression . He had already represented many right-wing extremists before and worked together with pride in this capacity.

On January 14, 2008, the Mannheim regional court sentenced Stolz to three and a half years in prison, and the court issued a five-year professional ban on her because she had abused her legal work to disseminate revisionist theses. Proudly acknowledged the judgment in court with the Hitler salute .

Proud appealed against the judgment revision one. In December 2008 the judgment was partially overturned and referred back to the regional court for a new hearing because of the sentence; However, the imposed professional ban continued after the decision of the Federal Court of Justice . In May 2009, the Mannheim Regional Court sentenced her to three years and three months' imprisonment for sedition - three months less than originally. The Federal Court of Justice rejected its renewed appeal in October 2009 as "obviously unfounded". She was released from custody on April 13, 2011 after serving her sentence in full. The judicial professional ban continued to apply until 2013, which meant that Stolz was not allowed to practice her profession as a lawyer even after her dismissal.

Proceedings at the Munich Regional Court 2015–2018

In November 2012, at the invitation of Ivo Sasek , the head of the so-called Anti-Censorship Coalition (AZK), Stolz appeared at an event in Chur . Because she again denied the Holocaust there and allegedly campaigned for right-wing extremism, the Bern lawyer Daniel Kettiger filed a complaint against Stolz and the organizer Sasek for alleged violations of the Swiss anti-racism law . After the proceedings had been referred to the German authorities, a trial began in Munich in February 2015 in which Wolfram Nahrath's pride was defended. On February 25, 2015, the Munich Regional Court sentenced Stolz to a prison sentence of one year and eight months' imprisonment without parole for sedition and abuse of titles (despite being excluded from the bar, she signed documents to the court with the professional title "Attorney") .

On May 3, 2016, the Federal Court of Justice overturned the Regional Court 's judgment regarding the abuse of professional titles, but upheld the relevant findings of the Regional Court throughout the sentence. According to the BGH, the regional court should reconsider the amount of the sentence, but not the judgment itself. On February 15, 2018, Sylvia Stolz was sentenced to a prison sentence of one and a half years without parole in the appeal process before the regional court in Munich. Since May 2019 she has been serving her sentence in the Aichach JVA .
