The Primary School Act ( VSG ; French Loi sur l'école obligatoire LEO ) is the school law of the Canton of Bern , it is based on the law of public primary schools from 1835. It is supplemented by the Primary School Ordinance (VSV) and the Day School Ordinance (TSV) dated May 28, 2008.

The Primary School Act has been revised since 2008 and is expected to come into force on August 1, 2013.

General

The scope of the Primary School Act applies to primary schools , including the compulsory schooling of nine years.

The language of instruction is French in the communes of the French-speaking part of the canton. French or German applies in the communities of Biel / Bienne and Evilard , the school is free to choose one language. German is spoken and taught in the other municipalities.

curriculum

Article 10 of the Primary School Act prescribes the following compulsory and optional instruction:

  • In the German-speaking part of the canton, compulsory instruction includes the following areas

    • Language / communication,
    • Nature / Environment / Technology / Economy / Housekeeping / Mathematics,
    • Design / handicrafts / works / music / sports.
  • In the French-speaking part of the canton, compulsory instruction includes the following areas
    • Arts,
    • Body and movement,
    • general education,
    • Language and communication,
    • Mathematics and natural sciences,
    • People & Society.

In the municipalities of Biel / Bienne and Evilard , compulsory teaching is carried out in German-speaking schools in accordance with paragraph 1, and in French-speaking schools in accordance with paragraph 2. The government council determines the compulsory and optional subjects by ordinance .

Revision of the Primary School Act 2012

In the referendum of September 27, 2009 , the voters of the canton of Bern accepted the cantonal proposal “Accession to the intercantonal agreement on the harmonization of elementary schools” or HarmoS concordat for short with 51.5 percent. The turnout was 38.7 percent. This revision had to be initiated.

The revision of the Elementary Schools Act 2012 (REVOS 2012) of the Canton of Bern is a partial revision with which the government council intends to implement the few missing elements of the HarmoS Concordat and the French- speaking Switzerland School Agreement as well as projects from the 2009 education strategy. Central elements of this revision are the introduction of a two-year kindergarten for all children, the possibility of leading basic level classes or a Cycle Elémentaire in the communities , improvements to the transitions between the educational levels and the cantonal co-financing of school social work .

The government council wants to ensure that stability and continuity are guaranteed in the primary school and that innovations are only made where the need for action is identified and a clear benefit can be recognized. The canton's financial leeway is also very limited. The measures are in the context of intercantonal harmonization and correspond to the requirements that were approved in the referendum. This thrust of the proposal was supported by a majority in the consultation .

The Education Directorate of the Canton of Bern is in charge. The implementation of REVOS 2012 is expected to take place in stages from August 1, 2013.

The most important changes

With the revision of the Primary School Act 2012, the government council is implementing the missing elements of the HarmoS Concordat and the French- speaking Swiss School Agreement. The government council deliberately refrained from a total revision of the elementary school law. Further reforms would put a heavy strain on the communities and schools . The government council only wants to make adjustments where there is a need for action and the chances of success are high. Children and young people should be optimally supported by REVOS 2012 through early support in kindergarten and through additional strengthening through school social work .

The main focus of the bill is to anchor the two-year kindergarten. The kindergarten becomes formally part of the elementary school , but remains as a level with a special development-specific pedagogy . The cut-off date for entry into kindergarten will be staggered from April 30th to July 31st. As of 2015 , all children who have reached the age of four before August 1 will start the two-year kindergarten. It is envisaged that the parents can decide whether to join the kindergarten later or to attend a reduced attendance in the first year of kindergarten. The reduction in the kindergarten workload is limited and justified by the child's level of development. Its aim is to gradually introduce the children to a full workload .

A special focus is on the school entry phase. Today, traditional school entry does not take sufficient account of the different levels of development and learning of children. The transition from kindergarten to first grade is to be made more flexible: The previously mandatory clarifications by the educational counseling centers for early or late entry into school are to be omitted.

Furthermore, REVOS 2012 creates the legal basis so that interested municipalities can voluntarily introduce a basic level or a cycle élémentaire (in the French-speaking part of the canton). The basic level takes into account the different learning requirements of the children, is age and performance mixed and ensures a smooth transition from playful to systematic learning. The Education Directorate should be given the opportunity to approve additional basic level classes per year according to certain criteria. The Education Directorate deliberately suggests not introducing the basic level. Such a system change would lead to significant additional expenses. In addition, the traditional kindergarten-school system has proven its worth. However, with the option of voluntarily introducing a basic level, the municipalities are given more leeway. You can choose the model that best suits your posture as well as the spatial and personal conditions.

In addition to the two-year kindergarten and the voluntary basic level, REVOS 2012 also creates the basis for adopting the language-regional curricula, plan d'études romand in the French-speaking and curriculum 21 in the German-speaking part of the canton, and for the organizational support of the courses in the native language and culture.

To relieve the schools, municipalities should receive financial support when they offer school social work . The municipalities should also be obliged to provide secretariats for the schools . So far, this has only been done on a voluntary basis.

Further topics of the education strategy, for example the optimization of the lower secondary level as well as measures to relieve the teachers, can be implemented with the existing legal basis and are not part of REVOS 2012.

The first reading of REVOS 2012 in the Grand Council will take place in the November 2011 session . The implementation is expected to take place in stages from August 1, 2013 .
