Walter Obwexer

Walter Obwexer (* 1965 in Brixen , South Tyrol ) is an Italian - Austrian legal scholar . Since 2012 he has been a university professor for European law , international law and international relations at the University of Innsbruck , since March 2015 also dean of studies and deputy dean of the law faculty.

Life

After completing compulsory school, Walter Obwexer attended the secondary school in Brixen from 1971 to 1979 in St. Peter ( Villnöß ) and Klausen , where he passed the high school diploma in 1984. He then began the "Integrated Diploma Course in Law " offered jointly by the Universities of Innsbruck and Padua , which he completed in 1990 with a diploma thesis on "The Accordino as an international law treaty in its current application and future development" as a Master of Laws.

After military service with the Italian mountain troops in the legal office in 1990/91, he worked as an assistant at the Institute for International Law, European Law and International Relations at the University of Innsbruck , where he obtained his doctorate in law in 1998 . Since 2003 he has been a lecturer in European law at the Management Center Innsbruck (MCI). In 2008 he completed his habilitation in the subjects of “European law and international law with special attention to international business law” with a thesis on “The right of Union citizens to move and reside freely as the fifth fundamental freedom” and was appointed associate professor. His habilitation thesis was publicly criticized for the fact that "almost a third of it had been secretly copied from his doctoral thesis", which is why an opinion of April 5, 2011 by the Austrian Agency for Scientific Integrity (ÖAWI) found that the principles of good scientific practice had been violated.

Despite the criticism, the new Rector Tilmann D. Märk (under the Austrian Science Minister Karlheinz Töchterle , his predecessor as Rector) was appointed University Professor for European Law, International Law and International Relations at the Institute for European Law at the University of Innsbruck on October 1, 2012 . On March 1, 2015, he was appointed Dean of Studies and Deputy Dean of the Faculty of Law at the University of Innsbruck.

Since 1991 he has been a scientific advisor to the South Tyrolean provincial government on EU issues, since 1994 scientific advisor to the Austrian Federal Ministries for Transport, Innovation and Technology , for Science and Research as well as the Ministry of the Interior and the Tyrolean provincial government on EU issues and the government of the Principality of Liechtenstein . Since 2002 he has also been a member of the EU advisory board of the Austrian federal government . In 2017, he therefore prepared the legal expertise on the planned German car toll for the Austrian Ministry of Transport , which became the basis for Austria's infringement proceedings against Germany at EU level; In 2019, the European Court of Justice (ECJ) ruled Austria's corresponding lawsuit that the German car toll violated EU law.

In October 2019, Obwexer was elected to succeed Ivo Hajnal as Senate Chairman of the University of Innsbruck for the term of office until September 2022.
