Wilhelm Schmidbauer (born February 20, 1958 in Regensburg ) is a German legal scholar and has been the Bavarian State Police President since July 2013 .

Life

Wilhelm Schmidbauer graduated from the Albrecht-Altdorfer-Gymnasium in Regensburg in 1977 . From 1977 to 1981 he studied law at the University of Regensburg . The first and second state exams took place in 1982 and 1985. From 1986 to 1987 he was a government councilor in the field of legal affairs, disciplinary law, damages and recourse at the Munich police headquarters . 1987/1988 he was a consultant in the Bavarian State Ministry of the Interior , subject area for police operations. In the summer semester of 1988 he received his doctorate at the University of Regensburg with the work on expropriation for the benefit of private individuals , which was suggested and supervised by Udo Steiner . The second reviewer was Otto Kimminich . After completing his doctorate, he was the personal assistant to the CSU Secretary General Erwin Huber until 1991 . From 1991 to 1994 he was head of the supply department at the police headquarters in Lower Bavaria / Upper Palatinate. In 1993 he became deputy head of the Kempten Police Department. From 1994 to 1999 Schmidbauer was the deputy head of the police department in the Bavarian State Ministry of the Interior. In 1996 he was teaching police and security law at the University of Regensburg. From 1999 to 2000 he was Deputy Police President and Head of the Deployment Department of the Police Headquarters in Lower Bavaria / Upper Palatinate. From 2000 to 2003 he was head of the police department in the Bavarian State Ministry of the Interior and, as a senior ministerial advisor, he was also deputy head of the public safety and order department. On March 20, 2003, Schmidbauer became police president and head of the Munich police headquarters, succeeding Roland Koller . In 2007 he was appointed honorary professor at the University of Regensburg. His areas of expertise are police and security law. Schmidbauer has been a member of the CSU for many years.

On July 1, 2013 Schmidbauer took over the office of the State Police President of Bavaria . He succeeded Waldemar Kindler , who was retiring.

Controversy

Meeting with Saif al-Arab al-Gaddafi

In 2011 Schmidbauer was exposed to public criticism after it was reported in the media that in August 2007 the Libyan embassy in Berlin invited him to a working lunch at the Munich 5-star hotel Bayerischer Hof . The Libyan embassy had complained about criminal investigations by the Munich police against Saif al-Arab al-Gaddafi , a son of the then Libyan head of state Muammar al-Gaddafi . In addition to representatives of the Libyan embassy, ​​Saif al-Arab al-Gaddafi himself also took part in the dinner. Members of the Bavarian Greens accused Schmidbauer that Saif Gaddafi's supposedly good relations with the police headquarters had something to do with the termination of numerous investigations pending against him . Schmidbauer justified his approach with the fact that it was an official invitation from the Libyan embassy and that he had informed Saif al-Arab al-Gaddafi about the legal system applicable in Germany, even if these instructions did not have a lasting effect. In particular, it was not a friendship meeting, as Saif al-Arab al-Gaddafi had demanded diplomatic immunity, police protection and a gun license during the meeting and was very angry about Schmidbauer's immediate rejection of these demands.

The meeting between Schmidbauer and Saif Gaddafi led to several parliamentary questions from the Bavarian Greens. The then Bavarian Interior Minister Günther Beckstein judged the conversation in retrospect as "definitely correct". After reviewing the process, the Legal Committee of the Bavarian State Parliament declared the application to be settled with the consent of all opposition parties.

Interview on assault by police officers

The parliamentary groups from the FDP , SPD and Greens strongly criticized Schmidbauer in the Bavarian state parliament , Interior Minister Joachim Herrmann (CSU) defended the police president. The case against the woman was later dropped, but the police officer concerned was sentenced to a suspended sentence of ten months.
