The process

A 46-year-old Pakistani worker was admitted to Rashid Hospital on January 14, 2009 with a cervical spine injury and paraplegia . Several investigations subsequently carried out, including by the Austrian Medical Association , the Higher Committee for Medical Liability (HCML) and the Dubai Health Authority, showed that Adelsmayr's actions could not have led to the death of the Pakistani man. The case was referred to the Dubai Public Prosecutor's Office in 2010 . The pleading to the death penalty indictment based on the following process on the Arabic translation to English written opinion by the Dubai Health Authority , where a friendly with one of the plaintiff doctors Egyptian doctor in charge of the investigations. The latter is suspected of being responsible for the manipulations proven by Adelsmayr's lawyers when translating into Arabic: “Everything exonerating has been left out” and new, incriminating sections have been added; a total of 19 pages are missing.

As a result of the events, Adelsmayr's medical license in Dubai was revoked in 2009 and his passport was revoked in 2010. This prevented him from leaving the UAE. Due to diplomatic efforts by the Austrian Foreign Ministry and because of his wife's serious illness, Adelsmayr was allowed to return to Austria for the first time on September 28, 2011 and from then on only visited Dubai for negotiation appointments. For family reasons and because the court tolerated and recognized questionable testimony, the falsified expert opinion and other irregularities, Adelsmayr did not attend a hearing for the first time in 2012. Adelsmayr's verdict on life imprisonment was passed by the judge on October 21, 2012 in his absence, which means that it has no legal force. The co-accused Indian colleague was acquitted.
