Gabriel Lansky

Gabriel Lansky (born December 27, 1955 in Vienna ) is an Austrian lawyer , in particular business and human rights lawyer as well as criminal defense attorney .

Life

Gabriel Lansky comes from a Jewish family; his mother was the only family member who survived the concentration camp in Auschwitz . His father survived because Cardinal Mindszenty hid him. Lansky self-published the story of his parents . Gabriel Lansky was born in Vienna. In 1979 he completed his law studies at the University of Vienna with a doctorate . In 1990 he was Udo Proksch's defender in the Lucona trial. Before opening his own law firm in 1991, Lansky worked as a study assistant at the Institute for Roman Law at the University of Vienna and as a lawyer in various Austrian law firms.

Lansky has been closely associated with the SPÖ for decades : Lansky headed an election platform for Alfred Gusenbauer in 2006 and ran three times on the lower list for the SPÖ in national elections . He was traded as a possible SPÖ Minister of Justice.

Gabriel Lansky is the author of publications on European law , the harmonization of the law of the various EU member states, the adoption of the “ acquis communautaire ”, EU public procurement law as well as criminal law and media law . Since 2009 he has headed the “Lobbying and Public Affairs” study program at the Law Faculty of the University of Vienna. Between 1995 and 1999 Lansky was a partner in a joint consulting firm with the women's rights activist Klaudia Thalhammer-Koch and the later politician Christoph Matznetter .

Lansky founded the law firm Lansky, Ganzger & Partner Rechtsanwälte GmbH in 2002 with the Viennese lawyer Gerald Ganzger . The law firm is represented in Vienna, Bratislava , Baku and Nur-Sultan . 140 people are employed at the Vienna headquarters.

Human rights lawyer

The focus of his legal activities as a human rights attorney from 1977 on were, above all, police attacks, police reform, freedom of expression and freedom of the media. He has successfully represented many cases before the European Court of Human Rights .

Gabriel Lansky has been an active member of Amnesty International since 1973 . For four years he was regional spokesman for the Vienna region and representative of the international organization of Amnesty International at the United Nations in Vienna. As head of the Austrian section, Lansky was responsible for asylum and legal issues.

He is a board member of Reporters Without Borders and the Institute for Intercultural Encounter "Trialog".

His law firm represented the government of Azerbaijan before the European Court of Human Rights. The subject matter was the conflict between Azerbaijan and Armenia over the Nagorno-Karabakh enclave , which was militarily occupied by Armenia more than 20 years ago (Sargsyan v. Azerbajjan case).

Kazakhstan

Lansky's work as representative of the widows of two managers of the Kazakh Nurbank who were murdered in 2007 attracted a lot of media attention . For years, Kazakhstan has been demanding the extradition of the former Kazakh ambassador to Austria, Rachat Shoraz (formerly Aliev). Lansky worked on behalf of the Tagdyr Association , which was suspected of being a cover organization of the Kazakh secret service KNB. This led to investigations by the Vienna Public Prosecutor's Office (later handed over to Linz) against Lansky because of Section 256 StGB (secret intelligence service to the disadvantage of Austria) . These investigations have now been legally discontinued by decision of the Linz Higher Regional Court on March 29, 2016 due to a lack of objective evidence on Tagdyr. The public prosecutor's office, according to the Linz Higher Regional Court, was also unable to prove “concrete, factual behavior”.

During the BVT affair , it became known that Lansky had handed over a bundle of allegations against the Federal Office for the Protection of the Constitution and Counter-Terrorism to the Secretary General of the Ministry of the Interior, Peter Goldgruber . According to his own statement, he was only concerned with data from his office, which the BVT may not have deleted after the proceedings were closed; he wanted to achieve that "finally something happens" in connection with this data.
