legality

Venezuela has no criminal laws against homosexual acts . Homosexual acts are uniformly exempt from punishment from the age of consent of 16 years.

Anti-discrimination laws

The draft of the 1999 constitution initially provided for the protection of sexual orientation . The inclusion of sexual orientation in Article 21 of the Constitution is currently being discussed in parliament.

Recognition of same-sex couples

Same-sex couples are not recognized by the state. In the parliament of Venezuela, the issue is debated by individual members. In a February 2008 decision by the Constitutional Court, same-sex marriage was not permitted.

Social situation

An LGBT community can be found primarily in the capital Caracas . The International Day of Gay Rights has been celebrated since 2000 and a Gay Pride Day has been proclaimed for the first time . LGBT organizations like Unión Afirmativa , Movimiento Gay Revolucionario and Orgullo GLBT de Venezuela support LGBT demonstrations in the country. Police harassment and homophobia affect the everyday life of homosexual people.
