Homosexuality in Peru

Homosexuality is legal in Peru ; Human rights activists, however, complain of a social intolerance towards homosexuals. There is neither the possibility of same-sex marriage nor of a registered partnership .

Homosexual acts have been legal in Peru since 1924. The age of consent is uniformly 14 years. However, "public morality" laws are often used against gays and lesbians.

There are anti-discrimination laws to protect sexual orientation in labor and civil law. In December 2009 the highest constitutional court in Lima ruled that homosexual people in the military and police in Peru do not have to hide their orientation in order to be able to perform their service. On the part of the state, same-sex couples are neither recognized in the form of same-sex marriage nor in the form of a registered partnership . From 2013, a bill to introduce a registered partnership was debated in the parliament of Peru, but this failed in March 2015.

Social situation

Compared to the South American states of Brazil or Argentina , the LGBT community in Peru is rather small. It is mainly found in the Peruvian capital Lima. The establishment of Movimiento Homosexual de Lima (MHOL) in the 1980s brought about a slight change in the way homosexuality was portrayed in the media. At the first Gay Pride parade in Lima in 2002, demonstrators wore face masks to raise awareness of the intolerance of Peruvian society.

Peruvian society, strongly influenced by the Roman Catholic Church , threatens well-known LGBT people with public persecution. In 2009, MHOL announced that there had been 470 deaths in Peru since 2005 due to hate crimes motivated by homophobia . The profile of the victims is typically "a man over 40 years of age living in a closet , as well as transvestites ".
