Homosexuality was taboo in Mexico in the past , but is increasingly recognized in the present.

Homosexuality has been legal in Mexico since the French Code pénal was adopted in 1810 during the occupation (1862–1867). The Mexican Penal Code, passed in 1871, had no penal provisions regarding homosexual acts. By 1998, however, public immorality laws were used against homosexual acts. The age of consent is 18 years.

Anti-discrimination laws

Since 2001, the Mexican constitution has banned discrimination based on sexual orientation nationwide . In 2003, a federal law protecting sexual minorities in Mexico was passed. Homosexual people can also serve in the military without restrictions.

  • In November 2006, registered partnerships ( Sociedad de Convivencia ) were approved for same-sex couples in the capital, Mexico City . The first couple to be partnered in Mexico are the journalist Antonio Medina and Jorge Cerpa.

    On January 11, 2007, the Mexican state of Coahuila in the northeast of the country also allowed registered partnerships ( Pacto Civil de Solidaridad ). The civil partnerships in Coahuila allow largely the same rights and obligations of a marriage with the exception of adoptions. In September 2014, Coahuila state finally opened marriage to same-sex couples. In July 2013, the state of Colima allowed civil partnerships.

    In other states of Mexico the approval of civil partnerships and a few years later the opening of marriages were discussed: Michoacán , Jalisco , State of Mexico , Puebla and Veracruz . Political support comes from the Mexican party Partido de la Revolución Democrática .

    In December 2009, the City Council of Mexico City passed a 39-20 vote to allow same-sex marriages in the area of ​​the capital of Mexico. The law came into effect on March 4, 2010. In August 2010, the Mexican Supreme Court upheld the opening of marriage in Mexico City as constitutional. In January 2012, the Caribbean port city of Cancun planned to open marriage to same-sex couples; it followed there in the state of Quintana Roo , in which the tourist city of Cancún is located, the opening of marriage. In December 2012, the Mexican Supreme Court ruled that same-sex marriages concluded in one state must be recognized in all other Mexican states.

    In June 2015, the Supreme Court of Mexico ruled that the ban on gays and lesbians from marriage violated the principle of equal treatment in the Mexican Constitution. The Suprema Corte de Justicia de la Nación did not order the immediate opening of marriage in the entire country. But same-sex couples have the right to force the marriage opening by an order before a district court in the respective states. In June 2015, Chihuahua was another state that opened marriage to same-sex couples. In July 2015, the state of Guerrero opened marriage to same-sex couples. In August 2015, the Suprema Corte de Justicia de la Nación ruled that a federal ban on adoption by same-sex couples was unconstitutional. In December 2015, the state of Nayarit allowed marriage to be opened, and in January 2016, the Suprema Corte de Justicia de la Nación approved marriage in the state of Jalisco . Further parliamentary marriages were opened in 2016 in the states of Campeche , Colima , Michoacán and Morelos .

    In July 2017, marriage was made possible by the highest court in the Mexican state of Chiapas . In August 2017, the opening of marriage was ordered by the highest court in the Mexican state of Puebla . In November 2007, the state government of Baja California, Mexico, made marriage possible for all. In May 2018, marriage will be ordered by the highest court in the Mexican state of Sinaloa . Same-sex marriage was made possible in the state of Nuevo León in February 2019 .

    A gay community can be found primarily in the capital Mexico City as well as in the large cities of Monterrey , Tijuana and Guadalajara . In the capital, the lesbian and gay district is located in the Zona Rosa (south of Paseo de la Reforma ). Puerto Vallarta is a popular vacation destination for gay tourists in Mexico. In rural Mexico, on the other hand, the climate is more homophobic .

    The lesbian magazine Lesvoz has been published since 1995 . Patria Jiménez was elected as a member of parliament in 1997 as the first openly lesbian politician. In 2006 an International Gay Film Festival started . In 2012 the IGLFA gay soccer world championship took place in Mexico from June 1st to 9th.
