Jörg Bergstedt
Jörg Bergstedt (born July 2, 1964 in Bleckede ) is a German environmental activist and publicist.
Conservation Youth
From the mid-1980s he was involved in the Naturschutzjugend (NAJU), the youth organization of the Naturschutzbund Deutschland . As a member of the NAJU federal executive committee, he represented an anarchist-radical democratic point of view and tried to take the association structures away from the NAJU, to decouple them from the NABU and to merge them with the BUNDjugend to form an environmental youth movement. The centralized structures should be changed to weekly group plenums with consensus decisions. He was expelled in 1990 on the grounds that he was "no longer based on the democratic basic order with his views."
Project workshop
Bergstedt lives in a project workshop in Reiskirchen / Saasen , which sees itself both as a conference center and meeting point for left-wing and environmental groups and as a political residential community . The Saasen project workshop is the follow-up project to the project of the same name in the old Trais-Horloff train station , in which Bergstedt was also already active.
Bergstedt is often seen by outsiders as the head of the project workshop because he has lived and been active there longer than other activists. He is considered a sharp critic of non-governmental organizations , whose political approach he considers reformist and state-supporting. In particular, the major environmental associations such as BUND , NABU and Attac are at the center of his criticism.
Bergstedt himself is also repeatedly criticized. This is usually determined by the fact that Bergstedt, as an individual anarchist, usually takes action himself, which is associated with the accusation that he is acting in a self-promotional manner. The allegations extend to the designation as a “guru” and “member of a political sect” by the former Giessen state security chief Puff in legal proceedings before the Giessen district court.
The Federal Constitutional Court describes him as an " opponent and opponent of the ruling economic and social system and an anarchist ". He advocates a society free of domination.
Destruction of genetic test fields
Since the mid-1990s, Bergstedt has been campaigning against the sowing of genetically modified plants, since genetic engineering only benefits corporations and is harmful to the human food chain. Because of the destruction of genetically modified barley plants on a test field of the University of Gießen on Whitsun Friday 2006, Bergstedt called them " field liberation ", charges were brought against Bergstedt in 2007. On September 4, 2008, he and another defendant were convicted of property damage and trespassing by the Gießen District Court. Bergstedt received a six-month prison term. The judgment was confirmed in July 2010 by the Frankfurt Higher Regional Court in the third instance.
Communication guerrilla
Bergstedt is an advocate of the methods of the communication guerrilla , which is manifested, for example, in changed election posters and billboards, forged "official" letters or stickers on products.
Bergstedt sometimes uses weird methodology, so he appeared with a large fabric TV screen and antennas on his head in what he called “Mars TV” in order to “document an absurdity of police presence in the role of a journalist from another world ". His actions and the skirmishes with the judiciary earned him the reputation of a political clown à la Fritz Teufel .
During Bergstedt's actions, there are often major police operations and detentions in order to enforce express dismissals if necessary.
Giessen processes
In a trial in April 2005, Bergstedt was sentenced to eight months in prison without parole. The charges were dangerous bodily harm , insult and damage to property . The act giving rise to the allegation of bodily harm occurred when Bergstedt was arrested under tumultuous circumstances in a spontaneous demonstration (communication guerrilla / hidden theater) directly in front of a CDU stand on January 11, 2003 and, according to police officers involved, resisted this arrest.
As of May 18, 2006 Bergstedt, should after the revision of the method was discarded his sentence in the prison begin casting. On May 14th, he was arrested by the Giessen police on suspicion that he had previously committed damage to property in Giessen by smearing paint. Following the arrest, a judge ordered interim custody. On May 17, the execution of the judgment, according to which Bergstedt had to go into custody on May 18, was suspended until at least November 15, 2006 by the 1st Chamber of the First Senate of the Federal Constitutional Court . The reason for this is a constitutional complaint that Bergstedt had submitted as a result of the trials. On April 30, 2007, the Constitutional Court finally ruled that Bergstedt's conviction for dangerous bodily harm and resistance to state power was unconstitutional, as Bergstedt's detention for the gathering was obviously illegal and Bergstedt may have been able to defend himself against the arrest. To test this circumstance, the process was to the district court casting remitted, the method in resistance ceased . The convictions for collective damage to property in six cases, for trespassing and for insulting became final.
The Frankfurt Higher Regional Court decided in another procedure on June 18, 2007 (Az. 20 W 221/06) that police operations against Bergstedt were unlawful, whereby previously established but concealed findings of the investigating authorities were used: “From the memo it emerges that the person concerned was observed between 2:28 and 2:47 a.m. playing badminton in the area of the Giessen judicial complex. After that, it is impossible that the person concerned has drilled a hole in the entrance door between 2.27 and 2.35 a.m. in the CDU office. "
The decision of the Higher Regional Court of Frankfurt also compares the methods used against Bergstedt with those of the Nazi era : “Since the instrument of detention was abused extremely massively during the Nazi era, it should be made legally impossible by the elements 'indispensable' and 'imminent' that the provision to authorize so-called preventive detention (formerly: protective custody) is expanded. "
Up until November 20, 2006, a new trial ran before the Giessen District Court, which involved the allegation that Bergstedt had perpetrated a graffiti attack on this same court. Bergstedt and the project workshop raised the allegation of the political judiciary and published extensive documents that evidence had been forged. On the other hand, he was accused of staging the proceedings in order to attract attention for his content. Bergstedt was sentenced in the first instance to a sentence of 140 daily rates, which was combined with the imprisonment sentence from the previous process that had not yet been completed to a total imprisonment sentence of 10 months. The second instance initially failed, on November 20, 2009 the proceedings were discontinued.
On May 23, 2007 Bergstedt was invited to Halle to repeat a court hearing. Shortly before the appointment, the court canceled the appointment and suspended the entire proceedings at state expense.
In the meantime, several police attacks and court rulings against Bergstedt himself have become the subject of investigations because evidence was obviously manipulated and the results of the investigation covered up. The public prosecutor's office at the higher regional court commissioned the Wiesbaden public prosecutor's office to investigate the Giessen police and judiciary. The agency ddp published an extensive research report on November 22, 2007, which largely confirmed the allegations. In 2011, the events were the subject of debates in the interior committee of the Hessian state parliament and a judicial review at the Frankfurt Higher Regional Court.
In October 2009, the district court of Gießen confirmed the six-month prison sentence for pulling out genetically modified barley from a test field at the University of Gießen in May 2006. The Hessian Higher Regional Court rejected the appeal and a constitutional complaint was not accepted by the Federal Constitutional Court. Bergstedt's arrival in prison was on September 23, 2010.
In November 2011 it became known that a preliminary investigation initiated in connection with the investigation into the unlawful arrest of Bergstedt against the then Hessian Interior Minister Volker Bouffier had been moved out of the focus of attention through file manipulation. Interior Ministry spokesman Mark Kohlbecher described this as "error correction". It was an "editorial change".
Enforcement of rights and civil rights
Bergstedt has not only been indicted several times himself, but has also won several victories as a plaintiff himself in courts, in which it was a matter of enforcing civil rights against state authorities. This includes:
- Successful constitutional complaint for violating the right to demonstrate
- Several successful complaints against police measures, including the decision of the Frankfurt Higher Regional Court of June 18, 2007, in which a police operation was compared with the protective custody practice of the Third Reich.
- Enforcement of the right to inspect files for undefended defendants in court (according to StPO) and enforcement of the right to inspect files for everyone in federal authorities (according to the Environmental Information Act)
- Training of laypeople as defense lawyers in court and “creative litigation” by lay defenders according to § 138 II StPO
- Successful lawsuit against the attempt by the state government of Hesse to introduce fees for demonstration registrations
At the end of 2011, Bergstedt took legal action in administrative courts against bans on demonstrations on large, fenced-in official property before the Administrative Court of Braunschweig, against the control of personal details when accessing Berlin courthouses and against the refusal of access to files by Forschungszentrum Jülich before the administrative court in Gießen.
Relationship to the protection of the constitution
Bergstedt is controversial within some groups of both the environmental and the radical left scene, as his temporary contact with the Office for the Protection of the Constitution made him a " persona non grata ". This contact is well documented and Bergstedt himself describes it as a political error. In most groups of the left-wing scene, any contact with the protection of the constitution is considered intolerable.
The core of the dispute is the question of how the state is generally dealt with. Bergstedt advocates the concept of creative anti-repression : you have to leave yourself open to various options instead of reacting schematically to the state, as most traditional leftists would practice.
In the reports for the protection of the constitution of the state of Hesse from 2004 and 2005, the project workshop in which Bergstedt is active is mentioned in connection with the processes in the context of the report on anarchist groups. The 2006 report went into more detail about the activities of the project workshop against genetic engineering and against the G8 summit in Heiligendamm.
