The Bavarian Association of Statutory Health Insurance Dentists (KZVB) is the largest of the 17 statutory dental associations in Germany. Members are over 10,000 Bavarian contract dentists, 1,800 of whom are salaried dentists who work in 7,000 practices (as of November 30, 2016). As a corporation under public law, the KZVB represents these dentists vis-à-vis the statutory health insurance companies and politicians. In addition, it ensures the dental care of the more than ten million patients with statutory health insurance in Bavaria across the board ( security order ) § 72 Fifth Book of the Social Code .
The KZVB is subject to the legal supervision of the Bavarian State Ministry for Health and Care (StMG), but decides on its own responsibility within the framework of the requirements of the fifth book of the Social Security Code. It also carries out sovereign tasks and carries an official seal .
The KZVB is one of 17 state KZVs. With the exception of North Rhine-Westphalia, which is divided into two KZV areas (KZV Nordrhein and KZV Westfalen-Lippe), the state concentration camps correspond to the federal states. All state concentration camps are members of the National Association of Statutory Health Insurance Dentists, Kdö.R. (KZBV). Every dentist must be a member of a state KZV in order to be able to settle the treatment of statutory health insurance patients. The KZVB was founded in 1950.
Tasks of the KZVB
Representation of interests
The organization represents the interests of the Bavarian contract dentists, orthodontists and oral surgeons and their patients towards the public, their supervisory authority, the statutory health insurance companies and other stakeholders in the health care system.
Advice to the legislator
The association advises ministries, authorities and legislators on all questions of contract dental health policy. This includes statements on proposed legislation, suggestions for improving health care and the development of political objectives.
Fee negotiations - fee distribution
The association negotiates regularly with the health insurances about the scope of services and the fee for contract dental treatments. It collects the bills of the dentists and forwards them to the health insurance companies. The budgeting (correct term: total remuneration ceiling ) limited the total fee volume until 2012 in the sense of a collective liability .
The impending budget overruns were mainly due to structural changes and the limitation of increases in the base wage increase , which meant that all other changes, such as higher cost increases in practices, could largely not be taken into account. In Section 85, Paragraph 3, Clause 2 of the fifth book of the Social Security Code , the Care Structure Act abolished the strict connection with the basic wages and introduced additional factors that have since then influenced the number and structure of insured persons, the development of morbidity , the cost and care structure, which is required for contract dental work Working hours as well as the type and scope of the dental services, insofar as they are based on a change in the statutory or statutory scope of services, are taken into account. At the beginning of 2013, a new starting point based on the volume of output in 2012 (technical jargon: reset ) compensated for the distortions that had arisen since the introduction of budgeting in 1993 through additional funding. At the same time, the different point values between primary funds and replacement funds have been standardized in each federal state on a volume-neutral basis.
If the total remuneration is still in danger of being exceeded, as has since been the case with those insured with AOK Bayern, a fee distribution standard (HVM) applies . Since the Supply Structure Act (= health reform of 2011) came into force, this has been decided by the KZV representative assembly in consultation with the health insurance companies. Until then, it had been agreed through a fee distribution agreement in agreement with the health insurance companies. In Bavaria, in such a case, so-called buffer days are used as a fee distribution instrument, on which the otherwise firmly agreed contract point value is suspended. First and foremost, the buffer days should primarily cause a decrease in the amount of work so that the agreed fee for each individual work performed does not decrease. There is a considerable difference here from the fee distribution agreement in the medical profession, which has introduced a so-called floating point value for this . There, the fee for each individual service decreases when the service volume increases.
Backup order
According to the statutory mandate, the organization has to ensure dental care in Bavaria. Contract medical care is to be regulated within the framework of the statutory provisions and the guidelines of the Federal Joint Committee through written contracts between the statutory health insurance associations and the associations of the health insurance funds in such a way that sufficient, appropriate and economic care is guaranteed for the insured, taking into account the generally recognized state of medical knowledge and the medical services are appropriately remunerated ( Section 72 (2) SGB V ).
Since January 1, 2009, the (dental) medical associations and the federal (dental) medical association have also been responsible for providing medical care for those insured in the industry-wide standard tariffs as well as the industry- uniform basic tariff and the emergency tariff with the medical services insured in these tariffs ( § 75 para. 3a sentence 1 SGB V). The legislator envisages either a so-called contractual solution, as introduced by the KZV Baden-Württemberg, or a corresponding regulation in the articles of association, for which z. B. the KZVen Hamburg, Hessen and Mecklenburg-Western Pomerania have decided. Implementation of the statutory regulatory mandate is still pending for Bavaria. So far, Bavarian dentists have been able to refuse the treatment of patients in the standard and basic tariff without penalty, as the statutory guarantee order directed to the KZV does not result in any direct treatment obligation for the individual doctors. Since the emergency tariff only provides medical care in the event of acute need for treatment and painful conditions, these patients are subject to professional (“ethical”) treatment obligations regardless of the statutory security order.
Requirements planning forms the basis for branch advice. On April 1, 2007, a health reform called the GKV Competition Strengthening Act came into force, which included the cancellation of the licensing restrictions for contract dentists without replacement. The law for the further development of organizational structures (GKV-OrgWG) abolished the statutory 68 age limit for contract dentists on January 1, 2009. Since then, freedom of establishment has existed.
Billing volumes
Around 16.2 million treatment cases per year are billed through the organization . A treatment case includes all individual dental services (fillings, injections, root treatments, x-rays, etc.) that are billed quarterly for a patient with statutory insurance. There are also 1.4 million dental prosthesis treatments billed. The fee volume is around 2 billion euros.

Testing
According to the statutory mandate, the KZVB has to check the billed dental services, as well as compliance with the training obligation and the maintenance of an in-house quality management system. She is responsible for quality assurance and, by means of the expert system, for assessing dental treatments.
Compulsory training
Regular participation in advanced training events is necessary to maintain the contract dentist license (regulated by Section 95d Book Five of the Social Code), otherwise there is a risk of a reduction in fees or the withdrawal of the license. According to the legal regulation, a contract dentist has to provide proof to the Association of Statutory Health Insurance Dentists every five years that he has complied with his training obligation in the past five-year period.
Dental quality management
From January 1, 2011, every contract dentist is obliged to maintain a quality management system (QM) in his practice. The basis for this is the QM guideline of the Federal Joint Committee (G-BA) on basic requirements for an institution-internal quality management in contract dental care from November 17, 2006, which in turn is based on § 135 SGB V. The dental associations have to monitor this.
Dental billing
The KZVB checks the submitted bills for factual and arithmetical correctness, i.e. whether all billing provisions and the associated quality standards have been met.
quality control
The KZVB advises its members on questions of contract dentist law and social law. She is the contact person for dental practices in matters of billing and has a comprehensive expert system . This is an instrument for quality assurance in dental treatment. In contrast, the statutory health insurance sector does not have an expert opinion. The services of the dentists are checked under professional and economic aspects according to criteria specified by the legislator.
public relation
The KZVB are in the publisher community with the Bavarian Chamber of Dentists , the Bavarian Zahnärzteblatt with specialized training and civil political out messages in a circulation of over 15,300 copies.
The magazine kzvb TRANSPARENT appears biweekly with political news, a publication for all Bavarian contract dentists (circulation 10,600 copies).
In Publisher Community with eight dentists' associations in other states the patient is published four blind spots, in a circulation of over 200,000 copies. It is available free of charge in the practices of the federal states involved.
Financing the KZVB
The administrative costs of the KZVB are financed by contributions to administrative costs from its members, i.e. the dentists. They are resolved annually by the KZVB representative assembly together with the adoption of the budget.
Bavarian Dental Day
The Bavarian Dental Day is the central advanced training event of the Association of Statutory Health Insurance Dentists in Bavaria and the Bavarian State Dental Association for both dentists and practice staff. The participants come from all over Germany and the German-speaking neighboring countries. The three-day event has been held annually in Munich since 1959 . It is at the same time a meeting point for representatives of health and professional politics and a training congress for practicing dentists. At the 54th Bavarian Dental Conference in 2013 there were 1,300 participants. It all starts with a ceremony on Thursday evening with leaders from the healthcare sector .
Emergency service
The KZVB also regulates the emergency dental service in the Free State of Bavaria through its eight district offices . As the first KZV in Germany, since 2011 - similar to the pharmacy emergency service - it has been offering the nearest dentist assigned to emergency service to those seeking help on a daily basis in its own emergency service portal.
Service for patients in Bavaria
The counseling center answers statutory insured persons questions about the dentist's bill and the treatment and cost plan. The advice is free. In addition, the KZVB offers a point of contact in its dentists' offices in Munich and Nuremberg for patients with statutory health insurance who would like to obtain a second opinion prior to dental prosthesis treatment. An independent patient advisor - an experienced dental expert - inspects the patient's dentition and advises the patient on the treatment and cost plan. In August 2011, the service for patients was expanded to include a second orthodontic opinion.
The organization
The highest decision-making body of the KZVB is the Representative Assembly (VV) with its two chairmen of the Representative Assembly. It consists of 27 delegates who are elected every six years. Dental professional associations apply for these elections. A full-time executive board is elected by the VV. An amendment to the articles of association on February 18, 2017 increased the number of delegates (“representatives”) from 27 to 45 for the future elections for the 2022 to 2028 term of office.
The full-time executive board represents the Bavarian health insurance dentists externally. The board of directors is supported by Walter Donhauser as commercial director and by approx. 300 administrative employees. Volunteer speakers, co-speakers and committee members also assist the board. The regional contacts of the KZVB are the chairmen of the eight district offices.
2005 to 2010
For the legislative period from 2005 to 2010, Alexander Süllner and Günther Schneider, Hammelburg, were chairmen of the representative assembly and Janusz Rat , Munich, chairmen of the board. His deputy was Martin Reissig from Ingolstadt. Both board members belong to the professional association Zukunft Zahnärzte Bayern e. V. (ZZB). Martin Reisig did not run again for the period from 2011 to 2016.
2011 to 2016
For the legislative period from 2011 to 2016, Günther Schneider, chairman of the assembly of representatives, his deputy was Axel Wiedenmann, Nuremberg, at the same time deputy chairman of the National Association of Statutory Health Insurance Dentists . Janusz Rat was re-elected as chairman of the board. Until July 31, 2016, his deputy was Stefan Böhm from Munich. Janusz Council did not run again for the 2017 to 2022 term.
2017 to 2022
For the 2017 to 2022 term of office, Reiner Zajitschek, Döhlau and Christian Ottl, Munich, were elected as the two chairmen of the representative assembly. Christian Berger, Kempten, was elected chairman of the board. His deputy is Rüdiger Schott, Sparneck. They belong to the professional association Free Association of German Dentists (FVDZ). Both are presidents of the Bavarian State Dental Association . After an expansion of the board of directors to three people by means of an amendment to the statutes, Manfred Kinner, Freising, was elected as the third board member on July 8, 2017.
Previous chair
Since the founding of the KZVB in 1950, the corporation has presided over seven chairmen of the board. In the founding phase, Fritz Linnert led the association as (provisional) chairman from January 15, 1949 . Until 2004 the board consisted of honorary members. Since 2005 the board has consisted of full-time directors.

Memorial to the withdrawal of medical license for Jewish dentists
On September 30, 2009, a commemorative plaque to mark the 70th anniversary of the by was Nazis decreed approval withdrawal of Jewish dentists in Munich Dental house in the dentists' association in Bavaria mounted, on which the names of dentists affected are listed of approval withdrawal from Bavaria. The 80th anniversary in 2019 was no longer commemorated by the new incumbent board and the memorial plaque was removed from its original place.
Gold Medal of Honor
Since 2010, the Bavarian Association of Statutory Health Insurance Dentists has been awarding the KZVB Gold Medal of Honor through its board of directors to personalities who have made special contributions to the Bavarian dental health system and the Bavarian contract dentists. Construction project
The chairman of the KZVB for the 2010–2016 term of office, Janusz Rat, initiated a residential construction project on the free portion of the property in 2012, which was approved by a majority of the representatives' meeting on May 12, 2014 with the votes of the Future Dentists Bavaria faction. Behind the dentist's house in Munich, 110 rental apartments and a daycare center will be built on the 6000 square meter section of the undeveloped property. In particular, the council wanted to make a contribution to reducing the housing shortage in Munich. The fixed assets of the Bavarian contract dentists are protected from creeping devaluation and the administrative cost contribution is kept at a low level. KZVB is investing around 30 million euros from its fixed assets in the construction project, thus responding to the European Central Bank's zero interest rate policy . The foundation stone was laid by the new board on September 29, 2017.
