On December 1, 2011, Braun was sworn in as Senator for Justice and Consumer Protection in the new Senate by Klaus Wowereit . The appointment met with criticism, including from the opposition and some media, as he worked as a notary with companies that have sold so-called junk properties using dubious methods and, according to consumer advocates, was actively involved in the mass sale of the worthless real estate. Braun denied the allegations. He stated that he had "dutifully provided information and advice" and referred to his notarial confidentiality. At the meeting of the House of Representatives on December 8, 2011, the governing mayor defended Braun, since in the legal sense there was nothing wrong with Braun's behavior. On December 12, 2011, Braun initially announced that he would rest his position as Senator for Consumer Protection and hand over this function to his State Secretary Sabine Toepfer-Kataw for a short time . His position as Justice Senator remains unaffected. Only hours later, after eleven days in office as Justice and Consumer Protection Senator, he asked Governing Mayor Wowereit to be dismissed. In contrast to a resignation, Braun secured a “transitional allowance” for at least six months.

The allegations made by Braun were examined by the public prosecutor's office and the president of the regional court as the supervisory authority for notaries. On March 20, 2012, the President of the Regional Court found that he had no evidence that Braun had worked with real estate sellers or distributors. He further stated that the prosecution two methods lack of sufficient evidence in accordance with § 170, para. 2 StPO set has. Even knowingly false notarizations are not to be blamed for Braun. At the same time, Braun announced that it would waive any further payment of the transition allowance and later repaid it two months.

On November 23, 2012, Braun announced that he no longer wanted to run for the district board of the CDU Steglitz-Zehlendorf.

In the legislative period until 2016 he was a member of the culture committee and research policy spokesman for the CDU parliamentary group.
