The Saxon Higher Administrative Court is the Higher Administrative Court (OVG) of the state of Saxony and forms the top of the administrative jurisdiction of this state .

history

The Saxon Higher Administrative Court is one of the oldest still existing today. It was founded on January 1, 1901.

Before that, legal control of administrative decisions had taken place in Saxony since 1835 by the so-called administrative justice system. At the administrative judicial measures of administrative checks by the administration itself. With the Saxon Law on the Administration of Administrative Justice of July 19, 1900, administrative justice was abolished. The law came into force on January 1, 1901.

First of all, the Higher Administrative Court began its work in the building of the police headquarters in Dresden . In 1909 the court moved into the Polytechnic School on Dresden Antonsplatz , which was built in 1844–46 for a forerunner of the TU Dresden and used from 1876 to 1908 by the Dresden School of Applied Arts . This building was badly damaged in the bombing raid on Dresden in February 1945. Up to this point in time the Higher Administrative Court still existed, but the court was more and more influenced by it during the time of National Socialism and experienced an institutional breakdown.

After the end of the Second World War , the Control Council Act No. 4 of the occupying powers, the Saxon Constitution of 1947 and the Constitution of the German Democratic Republic of 1949 provided for administrative jurisdiction . In the following GDR constitution from 1968, administrative jurisdiction no longer existed. The State Administrative Court of Saxony was only of minor importance.

Only after reunification were senates for administrative matters set up at the Dresden District Court . The Saxon Higher Administrative Court was finally re-established by the Saxon Court Organization Act of June 30, 1992 and received its current seat in Bautzen.

President of the OVG is Erich Künzler , who succeeded Siegfried Reich, who has retired, on July 1, 2007. Künzler had previously been Vice President of the Higher Administrative Court since December 1, 2005.

Matthias Grünberg has been Künzler's successor in the office of Vice President since January 1, 2008 . He was previously president of the Dresden Social Court .

  6. The essay by Christoph Jestaedt contained in this publication The Saxon Higher Administrative Court from 1901 to 1941 and its five presidents contains several errors. The author gives the reason for the end of the term of office of the OVG President Arnold Streit (1932), his death, but Streit did not die until 1940. His successor Otto Gäbler (1932–1933) is not mentioned at all.
