No smoking in passenger cars

A smoking ban in passenger cars prohibits tobacco (and often comparable substances) from being burned in the passenger compartment of an automobile. Smoking bans in passenger cars have been considered from various points of view:

Road safety

The historically older consideration concerns the risk to road traffic . From this point of view, the driver (and only the driver) should be prohibited from smoking while driving. It does not matter whether other people, especially children, are in the vehicle. It is argued that the driver of the vehicle is distracted by handling the cigarette, especially looking for it and lighting it, as much as by making a phone call or writing an SMS. In addition, a lit cigarette falling down can lead to panic-like reactions. Ultimately, a cigarette thrown out of the window can set other vehicles or their cargo on fire. Some serious traffic accidents can be attributed to smoking. The regional court of Lüneburg ruled in 2002 for the jurisprudence: “It can be assumed that a certain carelessness can already be seen in the fact that people smoke while driving. This impairs the ability to drive because he [the driver] cannot use both hands only to hold and operate the steering wheel when smoking. "

The attitude towards smoking while driving was by no means critical until the 1990s. In the middle of the 20th century there was even a very positive attitude towards smoking behind the wheel. The ADAC Motorwelt reported around 1952 of an English study by the “Safety First Organization”, according to which “drivers under the influence of nicotine have less alcoholic impairment in their driving performance” than without them. Those who smoked drunk drove safer, so to speak; the nicotine dampened the effect of the alcohol - a scientifically unproven thesis. Swedish investigations have shown that the "incorrect handling of the cigarette or the cigar at the wheel" has led to "incidents", but "it is possible to combat these smoking habits within a short time". The author of the article says that it is “of greater importance” to research which types of tobacco have kept which driver awake longest at the wheel. To do this, "ongoing cooperation between the tobacco and motorist associations must be secured".

Nonsmoker protection

In recent times, the knowledge of the harmfulness of passive smoking has established itself . From this point of view, smoking is prohibited not only to the driver of the vehicle, but to every person in the vehicle, but only if there are several people in the vehicle. In addition, there is usually the condition that the persons present in the vehicle must be minors.

Forest fires

Cigarette butts thrown out of the window regularly cause forest fires . For example (according to fire statistics from the Bouches-du-Rhône department in the south of France ) 16% of forest fires there are due to cigarette butts thrown from vehicles (and 13.8% to cigarette butts thrown away by pedestrians).

Countries and areas with no smoking in cars

Australia

In Queensland since January 2010, a ban on smoking in cars is true when minors under 16 are present years. The fee for a warning (on the spot fine) is 200 Australian dollars.

In South Australia , since May 2007, there has been a ban on smoking in cars if minors under the age of 16 are present. Penalties of 75 to 200 Australian dollars are envisaged.

In Tasmania , it has been banned since 1 January 2008, in cars with minors under 18 to smoke years. There is a fee-based warning of 110 Australian dollars.

In Victoria , as of January 1, 2010, smoking is banned in cars if minors under the age of 18 are present.

In Western Australia , a smoking ban in cars with minors under the age of 16 will come into effect in 2010 .

England, Wales and Scotland

If there are passengers under 18 who smoke in England or Wales , a fine of £ 50 should be expected, in Scotland a fine of £ 100.

France

Smoking is prohibited here if children under the age of 18 are traveling. Violations are punished with 68 euros.

Greece

In Greece , smoking has been banned in vehicles since December 2010 if children under the age of 12 are traveling with them. Fines of up to 1,500 euros can be expected here.

Italy

In Italy , smoking is prohibited in cars if pregnant women or minors are in the car. The penalty depends on the age of the child. If children under the age of 12 ride with you, you can expect a fine of 500 to 5000 euros. For children between 12 and 17 years of age, the amount of the fine is between 250 and 2,500 euros.

Ireland

In Ireland it is forbidden to smoke in the car when people under the age of 18 are present, otherwise there is a risk of fines of 100 euros or more.

Canada

In British Columbia since April 1, 2009, a ban on smoking in cars with minors under 16 years.

In New Brunswick since 1 January 2010, a ban on smoking in cars is true when minors under 16 are present years.

In Nova Scotia , as of April 1, 2008, smoking in vehicles with anyone under the age of 19 has been banned .

In Ontario , as of January 21, 2009, smoking in vehicles with minors under the age of 16 has been banned .

Austria

In Austria , smoking in cars in the presence of minors has been prohibited since May 1, 2018. Infringements can result in administrative penalties of up to 100 euros, and repetition of up to 1,000 euros.

South Africa

A law has been passed which, among other things, prohibits smoking in vehicles in which minors under the age of 12 are.

United States

Smoking bans in cars exist (with different age limits) in Arkansas , California , Louisiana , Maine and Oregon as well as in Puerto Rico and at the local level in various counties and cities.

United Arab Emirates

On January 6, 2010, a federal law was signed which replaces the smoking bans that already existed in some emirates. Among other things, this law prohibits smoking in vehicles with children under the age of 12 .

Cyprus

In Cyprus it is forbidden to smoke in private vehicles with minors under 16 years of age.

Planned smoking bans in cars

Finland

Finland intends to ban smoking in cars when there are children in them. In addition, smoking should generally be prohibited in places where children are located.

Israel

In Israel , the introduction of a smoking ban in cars is being discussed in the Knesset .

Canada

Saskatchewan Province plans to ban smoking in cars if minors under the age of 16 are in the vehicle.

Poland

The Polish government is working on a far-reaching ban on smoking, especially in rooms where children under the age of 13 are, including private vehicles and even homes.

Taiwan

The Republic of China (Taiwan) plans to ban smoking in cars, on motorcycles and for pedestrians on sidewalks. The reasons given are road safety and pollution from discarded cigarette butts. Regarding the smoking ban for pedestrians, it should be remembered that in East Asia (especially in Japan) it is uncommon to smoke while walking.

Other states

In several countries of the European Union smoking bans for cars are being discussed if there are minors in them, for example in the Netherlands, as well as in the European Parliament itself.
