Rohtenburg is a movie from 2006. It was directed by the former video clip director Martin Weisz, the main role is played by Thomas Kretschmann. The film is based on the actual events in the case of Armin Meiwes , who killed a man in a similar way in Rotenburg an der Fulda in March 2001 . The German theatrical release planned for March 9, 2006 was prohibited by an injunction from the Frankfurt Higher Regional Court . The Federal Court of Justice lifted the ban three years later. The film started in German cinemas on June 18, 2009.

The young criminal psychology student Katie Armstrong has chosen an unusual topic for her thesis. She would like to take a look at the media headlines and the background to a murder case in Germany. In Oliver Hartwin, she finds a criminal who searched the Internet for a victim who was willing to let him kill him. The victim was Simon Grombeck, who had agreed to Hartwin's plans and had also met with him.

Katie Armstrong begins her research in the hometown of the murderer. She finds evidence of a rather isolated life Hartwin, who for a long time was under the strict supervision of his dominant mother. He tried several times to escape this grip and thus also the wasteland of his home village. Over the years Hartwin also developed increasingly bizarre violent fantasies. During her research, the student is given a video anonymously. The violent death of Simon Grombeck is recorded in every detail on this video cassette.

The film alludes to the actual events surrounding the killing of Bernd Brandes by Armin Meiwes . In the course of media coverage of the criminal trial against Meiwes, Meiwes became known as the "cannibal of Rotenburg". Since this trial against Meiwes was still ongoing, Meiwes tried to take legal action against the film. He justified this, among other things, with the fact that he had not given his consent to processing his life in this form and the film, in particular with regard to ongoing criminal proceedings, violated his personal rights. In the film, Hartwin is portrayed as a bestial murderer, and Meiwes feared prejudice from the moviegoers and the media.

Legal consequences

On March 3, 2006, the Higher Regional Court of Frankfurt am Main issued an injunction at the request of Armin Meiwes , which prohibited the film from being shown. The plaintiff's personal rights are to be valued higher than a possible artistic processing of the subject, especially since the differences between film and reality could be presented "sufficiently credibly". The production company and distributor consider the judgment unconstitutional and see the freedom of art guaranteed in Article 5 of the Basic Law restricted. On 17 June 2008, the Higher Regional Court of Frankfurt am Main upheld a decision of the District Court of Kassel, which is the marketing forbade the film and thus essentially its decision dated March 3, 2006. The verdict was revision before the Federal Court inserted. Since this was approved, the judgment was not yet final. Although the film has not yet been shown in cinemas, several recordings with a German soundtrack appeared in several file sharing networks and P2P networks in 2007. On May 26, 2009 the ban was passed by VI. Civil Senate of the Federal Court of Justice repealed, taking into account the freedom of art and film.
