content

The story begins on April 29, 1997 in Graefenhausen near Pforzheim. The draftsman Harry Wörz meets a large police presence when leaving his apartment and is immediately arrested. He is accused of attacking his separated wife, who is also a police officer, in her apartment and strangling her so badly that she has suffered permanent brain damage due to lack of oxygen and will become a need for care.

Wörz is sentenced to 11 years imprisonment by the Karlsruhe Regional Court for attempted manslaughter. In 1999 he was brought to court for damages in which the lawyer Hubert Gorka represented him. The judge at the competent civil court has doubts about Wörz's guilt and dismisses the claim. Because of this success, Wörz and his lawyer Gorka decide to fight for the sentence to be lifted. Years of litigation begin. Together, the two fight their way through retrial proceedings and revision negotiations up to the Federal Court of Justice .

On October 6, 2005, Wörz was acquitted "for lack of evidence" and the negligent work of the originally investigating authorities was established. Nevertheless, the court lets it be known that it considers Wörz to be the guilty party and overturns the judgment in the appeal. It was not until four years later that the court found unequivocally that he was innocent and should never have been convicted. This judgment is also confirmed in the revision.

In addition to the legal processes, the film also tells about Wörz's relationship with his lawyer Gorka and with old and new friends.

background

The TV film Under Charge: The Harry Wörz Case is a UFA Fiction production on behalf of SWR and ARD Degeto. Most of the shooting took place in Berlin, but some shots were also shot in the vicinity of Graefenhausen near Pforzheim, Harry Wörz's hometown.

The Harry Wörz case not only reveals the weaknesses and strengths of the German judicial system, but also deals with the issues of manipulation and corruption. The police suppressed evidence in the trials and excluded other possible perpetrators from the outset. The film condenses the many processes, negotiations and hearings with montages and collages in order to give more space to the emotional moments of the Harry Wörz case.
