When drinking in public activities where the consumption of alcoholic beverages is prohibited in public places in whole or in part and is covered with fine are referred to.

Germany

General public

In principle, the general freedom of action applies under German law ( Article 2, Paragraph 1 of the Basic Law ), as long as it is not restricted by appropriate regulations. Therefore, some cities in Germany tried to prevent harassment and violent crimes by heavily drunk people in public places by prohibiting the consumption of alcohol in public.

As early as 1999, the Berlin Roads Act prohibited alcohol consumption in public. This could be punished with 10 Euro fine and a dismissal. However, this was lifted again in mid-2006. In the course of 2008, however, other cities in Germany introduced a public alcohol ban, such as Marburg on December 16, 2007 (limited to one year) and Freiburg im Breisgau on January 1, 2008. This example followed in the course of the year including the cities of Erfurt , Magdeburg , Bamberg , Ilmenau and Görlitz .

However, this practice is legally controversial. On July 28, 2009, the administrative court of Baden-Württemberg in Mannheim lifted the Freiburg alcohol ban. The regulation in Magdeburg was declared invalid by the Higher Administrative Court of Magdeburg on March 17, 2010 and in Erfurt by the Higher Administrative Court of Weimar on June 21, 2012. The judges saw the prohibition from the so-called Hazard Defense Ordinance as too vague.

Public transport in Germany

In addition to cities, transport companies are also trying to reduce nuisance to other passengers and vandalism by prohibiting alcohol . According to the rules of many conditions of carriage, heavily drunk people who pose a danger to themselves and others have not been allowed to use the public transport of the respective company or transport association for a long time. These regulations have been expanded in some cities so that the consumption of alcohol in vehicles is also prohibited. This applies in Germany in the Rheinbahn (since July 1st, 2007), DSW 21 , BOGESTRA , HCR , Vestische Straßenbahnen (all since June 2008), in the Verkehrsverbund Stuttgart (since January 1st, 2009), with the Münchner Verkehrsgesellschaft (August 1st 2009), at metronom Eisenbahngesellschaft (since November 15, 2009), at VAG Nürnberg (since January 1, 2011) and at Duisburger Verkehrsgesellschaft (since March 18, 2011). On July 1, 2011, an alcohol consumption ban was imposed in Hanover Central Station . In the Hamburg transport association , this regulation was introduced for most transport companies on September 1, 2011. However, the HADAG ferries as well as the Northern Railway trains and the DB Regio trains are still excluded from this . After a ban on alcohol consumption in the vehicles of the Münchner Verkehrsgesellschaft since August 2009, the Munich S-Bahn followed suit on December 12, 2011 .

Since October 19, 2012, there has been a ban on alcohol consumption at Nuremberg Central Station on Fridays from 8 p.m. to 6 a.m. on Sundays and on public holidays from 8 p.m. on the previous day to 6 a.m. on the following day.

In the buses and trams operated by Kölner Verkehrsbetriebe AG, the consumption and carrying of alcoholic beverages in open containers is prohibited by the general ban on eating and drinking, which was introduced in 2007. As of September 1, 2013, this regulation was extended to the KVB underground stations. Violations of the alcohol ban can result in a fine of 40 € and eviction from the house, in the event of repetition, a house ban can also be issued. The alcohol ban also applies to trams operated by Stadtwerke Bonn AG (SWB) for journeys on lines 16 and 18 while these are in the Cologne city area.

The consumption of alcohol is prohibited in the underground stations and in the Rheinbahn vehicles .

Italy

In Veneto Jesolo the consumption of alcoholic beverages in the direct public and its sale on Saturday 14 July to 27 December is prohibited.

Austria

Overview

  • Graz: On the main square - here there is a grocery store, as well as outdoor dining areas, market stalls, snack stalls, two of them in the evening and at night - only independent drinking of alcohol has been prohibited for several years, because for consumption (sitting) in the outdoor dining areas of two bars and restaurants Alcohol consumption is permitted at the snack stands at their bar tables.
  • Klagenfurt: After alcohol-induced excesses, an alcohol ban was enacted on a test basis from April 1, 2018 until the end of October at Heiligengeistplatz - with the bus station for city and regional buses - and at Lendhafen (= at the east end of the Lend Canal ). In the seating gardens "it is of course allowed to consume alcohol."
  • Vienna: Since April 27, 2018, there has been an alcohol ban in the Wiener Praterstern , the train station of the same name and the subway station as well as in the adjacent streets and green spaces, which prohibits drinking and carrying alcoholic beverages in open containers. The designated mayor Michael Ludwig (SPÖ) announced his intention to introduce a ban on alcohol at the Praterstern in cooperation with the outgoing mayor Michael Häupl (SPÖ) in April 2018. It is the first location-based alcohol ban in Vienna, with the exception of catering establishments and snack bars, but the sale of alcoholic beverages, for example in supermarkets and tobacconists, is still allowed.
  • Public transport in Vienna: There is a general ban on alcohol in the underground trains, trams and buses of Wiener Linien as well as in the underground and USTRAB stations .
  • Salzburg: In Salzburg there is a general alcohol ban on the station forecourt, Südtiroler Platz and in the main train station .
  • Innsbruck: In Innsbruck, alcohol consumption was prohibited in several public places. Among other things, this affects the main train station and parts of Maria-Theresien-Straße .
  • Dornbirn : There is also a ban on alcohol in the Dornbirn train station.

Poland

In Poland there is a general ban on alcohol in public, with the exception of the immediate vicinity of restaurants and pubs . Since 2012 (in the course of the European Football Championship 2012 ) this has been expanded to include mass events such as stadiums and concerts.

Czech Republic

Since July 7, 2008, there has been a ban on alcohol in public in the city center of the Czech capital Prague . Outside of restaurants, street cafes and refreshment stands, only non-alcoholic beverages may be consumed in large parts of the city center. In October 2013 the ban was extended considerably. B. is now prohibited to consume alcohol in public within 100 m of playgrounds. A violation is punished with approx. 40 euros.

United States

Following the lifting of the alcohol ban, many parts of the country have banned alcohol consumption in public in the United States .

Internationally in public transport
