The ordinance on pollution control and accident officers (5th BImSchV) describes for which systems an pollution control officer and an incident control officer are to be used according to the Federal Immission Control Act and which requirements are placed on the qualifications of these persons.

When an immission control officer belonging to the company is to be appointed, is shown in Appendix 1 to this ordinance. This relates to plants that require approval in the sense of the ordinance on plants that require approval .

For systems within the meaning of the Hazardous Incident Ordinance , an incident officer should also be appointed. The immission control officer and the accident officer can be the same person. There is, however, a margin of discretion: at the request of the operator, the competent authority may permit the appointment of an accident management officer to be omitted if it is clearly excluded that the relevant installation requiring approval can pose a risk of an accident (Section 1 (2) sentence 2 5th BImSchV ).

The contents of the ordinance on the specialist knowledge and reliability of the immission control officers have been adopted into the ordinance on pollution control and accident officers . This was repealed when the 5th BImSchV came into force.
