The Ordinance on Electromagnetic Fields (26th BImSchV) contains requirements for the protection of the general public and the neighborhood against harmful environmental impacts and for precaution against harmful environmental impacts from electrical, magnetic and electromagnetic fields or for electromagnetic environmental compatibility - EMC . It should not be confused with the Ordinance on the Protection of Employees from Hazards from Electromagnetic Fields (Occupational Health and Safety Ordinance on Electromagnetic Fields - EMFV)
history
Since the ordinance came into force in 1997, there has been a need to revise the limit values for the electromagnetic fields caused by cell phone masts. An amendment to the 26th BImSchV was also made in connection with the planned expansion of renewable energy . In 2016 the general administrative regulation for the implementation of the regulation on electromagnetic fields - 26th BImSchV (26th BImSchVVwV) came into force.

It covers areas of application of electrical energy that are associated with low-frequency electrical and magnetic fields, such as B. the power transmission. In addition, the ordinance also provides for regulations for high-voltage direct current transmission systems (HVDC systems) - a new technology that will be used in the expansion of the power grid , but was previously unregulated.
The limit values are based on the recommendations of the Radiation Protection Commission (SSK), the International Commission for Protection against Non-Ionizing Radiation (ICNIRP) and the Council of the European Community and are binding in all places that are intended for permanent or temporary residence.
The location certificate, which the respective operator of a system must apply to the Federal Network Agency for Electricity, Gas, Telecommunications, Post and Railroad ( Federal Network Agency ) for all transmission systems, serves as proof of the fulfillment of this requirement . Location certificates are issued by the Federal Network Agency on the basis of the Ordinance on the Verification Procedure for Limiting Electromagnetic Fields (BEMFV).
The new regulations also include, in particular, regulations on preventive health protection. Power lines built after August 22, 2013 may no longer span residential buildings. Likewise, when expanding the power grid, electrical and magnetic fields should be minimized as much as possible. In contrast to the previous regulation, not only commercially operated radio systems, but also private and publicly operated systems are recorded.
The regulation still does not take into account the effects of electrical, magnetic and electromagnetic fields on electrically or electronically operated implants .
scope
The ordinance applies to the construction and operation of high-frequency systems , low-frequency systems and direct current systems that serve private or commercial purposes or are used in the context of commercial ventures and do not require a formal approval process with public participation in accordance with Section 10 of the Federal Immission Control Act (BImschG).
The regulation applies to stationary
- High-frequency systems that generate electromagnetic fields in the frequency range from 9 kilohertz to 300 gigahertz, with the exception of systems that generate broadband electromagnetic pulses and serve national defense,
- Low-frequency installations for the transformation and transmission of electricity with a nominal voltage of 1000 volts or more, including traction current transmission - and
- overhead lines and other similar equipment in the frequency range of 1 Hz to 9 kHz,
- DC systems for transmission, voltage conversion and conversion, including switch panels for direct current with a nominal voltage of 2,000 volts or more.
Limit values
High frequency systems
High-frequency systems with an equivalent isotropic radiation power (EIRP) of 10 watts or more are to be set up and operated in such a way that the limit values specified in Annex 1a and 1b for the respective frequency range, taking into account immissions from other fixed high-frequency systems and low-frequency systems and in the case of pulsed electromagnetic fields, depending on the frequency range, up to 32 times the values in Annex 1b are not exceeded.
Short-term exceedances are permitted in the event of a temporary danger to public safety and order or to protect the security of the state.
When selecting locations for high-frequency systems to be built after August 22, 2013, the municipalities in whose area the high-frequency system is to be built can discuss the construction measure with the operator. The opinion of the municipality must be taken into account when choosing a location (municipal planning sovereignty ).
Low frequency systems
Low-frequency systems that are built after August 22, 2013 are to be set up and operated in such a way that they do not exceed the limit values specified in Appendix 1a when the system is at full capacity, whereby low-frequency systems with a frequency of 50 Hertz are half of those specified in Appendix 1a The limit value of the magnetic flux density must not be exceeded.
Old systems that were built or significantly modified before August 22, 2013, but after December 16, 1996, are grandfathered. Short-term exceeding of the limit values by no more than 100% for a maximum of 72 minutes within 24 hours and small-scale exceeding of the limit values of the electric field strength by no more than 100% outside of buildings, unless these are unreasonable in individual cases for the neighborhood .
Low-frequency systems with a frequency of 16.7 Hertz, which were installed before August 22, 2013, may exceed the limit value of the electric field strength specified in Appendix 1a by up to 100% up to August 22, 2018 at maximum plant utilization.
However, these exceptions do not apply to a significant change in low-frequency systems in the vicinity of homes, hospitals, schools, kindergartens, day nurseries and playgrounds. In these buildings or on these properties, the maximum effective values of the electric field strength and magnetic flux density must, without exception, correspond to the new limit values.
DC systems
Direct current systems are to be set up and operated in such a way that the limit value of the magnetic flux density specified in Appendix 1a is not exceeded when the system is at its maximum capacity and that effects such as spark discharges between people and conductive objects, which can lead to considerable nuisance or damage, are avoided. All relevant immissions must be taken into account.

Exceeding the relevant limit values during the construction, operation or modification of a system can be punished as an administrative offense with a fine of up to 50,000 euros (Section 9 No. 1 and No. 2 26th BImschV, Section 62 Paragraph 1 No. 7, Para. 4 BImschG ).
