The ordinance on the regulations of the biofuel quota (36th BImSchV) supplements the provisions of the Biofuel Quota Act and Sections 37 a – c of the Federal Immission Control Act. Various European directives have thus been implemented in German law.

Section 7 stipulates that biofuels, weighted twice, can be counted towards meeting the biofuel quotas if they are made from the following materials:

  • Waste to which the provisions of the Recycling Management Act apply
  • Residues
  • cellulosic non-food material
  • lignocellulosic material

Residual materials can be:

  • Raw glycerine
  • Tall oil pitch
  • Liquid manure and manure
  • straw
  • Used cooking fats and oils

For double weighting, a double weighting certificate and a sustainability certificate must be issued. For this purpose, collectors and processors of waste must be certified within a certification system recognized by the Federal Agency for Agriculture and Food . This is to ensure a comprehensive control of the sustainability and double crediting of liquid and gaseous biofuels. This is particularly intended to prevent the artificial generation of waste for the production of biofuels that can be counted twice.
