Andreas Werner Tilp (born March 24, 1963 in Plochingen ; † April 1, 2021 near Tübingen ) was a German lawyer .

Life

Tilp grew up in Ebersbach an der Fils . From the 1985 winter semester he studied law at the University of Tübingen . In 1994 he completed his legal traineeship in Baden-Württemberg with the second state examination and founded his own law firm in Tübingen, which moved to Kirchentellinsfurt in 1998 and has been operating under the name TILP Rechtsanwaltsgesellschaft mbH since 2011 . The law firm has specialized in banking and capital market law from the start and only represents investors and investors. In 2004 he founded a law firm in New York with TILP PLLC , followed by others in Switzerland and Funchalin Madeira . Since 2004 Tilp has also been a lecturer at the German Lawyers Academy. As an officially appointed expert, he took part in hearings in the German Bundestag , the EU Commission and government commissions , including in the reform of the Investor Model Act (KapMuG) and the AIFM Implementation Act.

In December 2006, the Federal Court of Justice (BGH) ruled that banks are obliged to inform investors about so-called kick-backs and that investors are entitled to compensation if insufficient information is provided . Tilp represented the plaintiff investor in this process. In a further ruling in 2014, the BGH decided that all commissions must be disclosed to the customer .

From 2007 onwards, Tilp represented the model plaintiff in the proceedings against Deutsche Telekom , who was accused of having published incorrect information in stock market prospectuses as part of its third IPO of the so-called T-Share in 2000 . After the Frankfurt Higher Regional Court had approved the prospectus in May 2012, the Federal Court of Justice ruled the model plaintiff right on the central point in October 2014. During the proceedings, Tilp criticized the KapMuG, which he later helped to reform, as this neither prevented the mass of individual lawsuits nor improved the position of the individual plaintiffs.

In the test case started in 2010 against Hypo Real Estate due to balance sheet manipulation and prospectus liability, Tilp also represented the model plaintiff. The Munich Higher Regional Court ruled that incorrect information was disseminated in the stock market prospectus and that investors were not adequately informed about losses as a result of the securities crisis in the USA.

In November 2014, Tilp, who was already the representative of two Porsche lawsuits by an investor institution, applied for a test case against Porsche SE . The latter is accused of having disseminated false information several times in relation to the purchase of shares in Volkswagen AG and thus harming investors.

In the course of the VW emissions scandal , Tilp represented an investor at the Braunschweig Regional Court who is demanding 20,000 euros in damages from Volkswagen AG. This procedure was also designated as a model procedure.

Tilp was a member of the German-American Lawyers Association and from 2011 to 2018 Deputy Chairman of the DAV Legislative Committee for Banking and Capital Markets Law. From 1997 to 2011 he was co-editor of the magazine “ Consumer and Law” .

Tilp was married and had three children.

Andreas Tilp died on April 1, 2021, near his home in Tübingen, of a head injury when he came off a forest path with his pedelec without any outside interference and fell down a slope.

Trivia

During his studies, Tilp lost over 400,000 marks in speculative transactions financed by loans on October 19, 1987 , but was able to successfully defend himself against having to repay the debt. He himself stated that through this he had found his legal area of ​​expertise.
